Okay - Couldn't let this go by without posting here . . .
I just recently found out that not only has "Smoking" anything been banned anywhere in the apartment complex where I live as of July 1st (which I knew was going to happen) . . . When I got a copy of the revised "House Rules" saw that the management here included that using an "eCig"/"Vaping" in "My" apartment or on the property is now verboten too . . .
AND - All because the "Smoke Free Florida" people advised the management that they must include that clause . . . (Insert inappropriate hand gesture here

)
Long story short -
I AM NOT A HAPPY CAMPER . . .
WHAT Really Gets "Me" - Is that I am already having a hard enough time trying to become a fulltime vapor and quit smoking totally - and now this . . . Dam if Ya' Do - Dam If Ya' Don't . . .
That is scary. One thing that's come to light is these groups are doing everything they can to list vaping as smoking which if successful, has the side effect of limiting legal challenges to deeming regulations. Pretty serious consequences to let slide.
I assume there wasn't a change to extend the "indoor Clean Air Act" by the city, council or state? That's usually how it becomes "official" and if they attempt it, the expansion gets some push back. This feels like an end run around getting that official determination (democracy) and is arbitrary.
You might point out vaping is not regulated by the FDA the same as tobacco. They are lying if they said so. The FDA doesn't have jurisdiction over ecigs like they do with tobacco and that's what is happening now because it is not the same, ecigs aren't in the same category as cigarettes! The FDA does NOT treat them the same. Tell them they can't enforce restrictions on vaping because they don't give off smoke or odors and it's stupid. (Repeated in as many ways as possible).
Can you get a doctor's note advising preference for vaping? (Kind of a long shot).
I don't think vaping is a protected class for driscrimination - however this does change your lease substaintially from when you signed and you should be able to break it without consequences. That's probably not the ideal solution. The next best would be stealth vaping. Who knows you vape in your home that cares? I think reheating last night's leftovers smell much more than even the strongest eliquid. Are you smoking strawberries and cocoa again? tsk, tsk, tsk. LOL!
I'd also contact CASAA since this is a sneaky way to get around passing public policy and ordinances (democracy) and influences public opinion. As far as I know, no "Smoke Free (state)" has any authority to pass or enforce public policy or ordinances.
In fact if they have recieved federal funding, it could be against the law (save any documentation you can find. A group in No. Calif is working on this).
I'd also start a thread in the general section or legislative section to see how many others have experienced the same thing. People need to know this is happening. Post in Redditt, VM, Underground, everywhere. Then write letters. You might get lucky and find a councilperson who doesn't like their authority (power) upsurped that way.
