Why Do People Knowingly Buy Clones?

Since most modders don't hold patents or copyrights..... That might be difficult :p

Edit: Even most of the logos aren't properly trademarked

In this Country, do you Have to have a Patent before you have any Properties Rights?

For most companys patents are too expensive and a waste of money. I delved into that area for awhile when I manufactured fitness equipment. Patent laws are very complex and patent attorneys make very good money for their time. I could only patent innovative parts of a machine and the parts could easily be modified and marketed legally anyway. To contest issues is even more costly and time consuming. In most cases it appears that only Fortune 500 companies could feasibly utilize patent protection. I didn't make enough to warrant tax write offs for foolin with them. :2c:

Odd... BACA has copyright on our logo (and it's derivatives). Is copyright law that much easier than patent law?

Yes and you can use pat pending and put trademark on anything. By law you are covered for certain rights but it can cost you to enforce them. You can't get a "blanket" type patent to cover your ideas.

Personally I feel that there are many great attys at a reasonable price $20-30, that it just doesn't make sense to buy a clone (copy, counterfeit) to save $5-10. And I would never buy/own/use a high dollar designer device... no need when there are other options that work every bit as well for a reasonable price.

What my Question was in This Country, are there Any Protections afforded (Pun Intended) to someone who comes up with a Unique Product, and Can Verify the Concept Date, if they do Not have a Patent or a Patent Pending?

Yep, trademark exists upon use in the market.

Clearly, as everyone recognizes, there is value to the original design and identification, which is why IP is violated by cloning.

Even Patents aren't a guarantee of ownership, and they don't mean you automatically get to stop a company from making "an identical product".
Patents are simply a great piece of evidence for when you sue in court.
If you have the time or money to sue

I don't think many people here have a clue what a patent actually is or what protections a patent affords.

Well - clones are cheaper and may encourage you to buy the real thing. I don't get clones of a mech mod, though. In fact I don't get mech mods these days. Why live in a cave when you can live in a regulated apartment? Oh, sub-ohm. Personally I value my teeth. :)

I like mechs for their relative sturdiness and potential longevity, far past that of any electronic device -- if the FDA goes completely nuts, I don't want to have to do my own flashlight modifications. :D Because I'll be double-damned if I'll go back to closed system cigalikes -- I didn't even use those when I started, I had an eRoll I could put my own ejuice in!

Right now I use a Kick in my mech, and for the mech I just ordered, I also ordered a Kick... but the mechs would still work, even if/when the Kicks finally die. And oh yeah, both of my mechs, and both of my Kicks, are clones -- the Kicks are Smok, because the eVolv ones are ridiculously expensive, and I don't need more than 15w anyway. The mods are a Fallen Angel, and just ordered the Smok Galileo. And a few days ago, I ordered the amgaM clone of the Magma, by Tobeco. I don't need logos, but I do need hardware that works well for a price I
can afford.

And if, GOD FORBID, there was ever one of those EMP things... the mechs would still work. :D
