I don't see e-cigarettes fitting the definition of "cigarette" nor do I see "e-cigarette" or "tobacco products" in any of that. Until the PACT Act is amended to include them, I don't see how USPS can refuse to ship them.

I argued the point of the definition of a 'cigarette' initially when the deeming regs came out, but was told it was a dead horse. E-cigarettes do not fit the description as stated in US code 5 either, but that has not stopped them from other avenues as seen in the deeming regs.

471.1 Cigarette
Any roll of tobacco wrapped in paper or in any substance not containing tobacco, and any roll of tobacco wrapped in any substance containing tobacco, which because of its appearance, the type of tobacco used in the filler, or its packaging and labeling, is likely to be offered to, or purchased by, consumers as a cigarette. The term cigarette includes roll-your-own-tobacco and excludes cigars.

471.2 Smokeless Tobacco
Any finely cut, ground, powdered, or leaf tobacco that is intended to be placed in the oral or nasal cavity or otherwise consumed without being combusted.

    People who have experience buying parts from ebay, what do you look for in a vendor? Thinking state side, over 99% positive reviews, anything else? Need some Kanger RBA's still, maybe a few replacement glass... might just order cheap clones with RBA's from the looks of things.

    I have been reading up on FDA authority and yes they do have it over other agencies when they are sole authority. The FDA already has a presence at our ports of import of goods and with an agreement with Customs and Border control any item the FDA oversees comes under FDA authority like import of foods, drugs, tobacco, etc. They have an electronic scanning system now and it is coded for FDA. Any FDA codes that are a red flag get opened and inspected, plus they do sample inspections also. This was all in place before the ruling over e cigs so nothing new in procedure just new that ecigs are now deemed tobacco product. So if FDA says this or that does not get thru, they have final say not customs or USPS, all imports have to pass muster with FDA on the products they regulate. Now for domestic shipping of ecigs after 8-8 we have to see if that Keeps kids Free of tobacco law amends the pact act to include ecigs deemed tobacco and included in no shipping thru USPS. No way of knowing at this point. What I do know is that shipping cigs was once legal then banned after one law or rule was passed, so things can change anytime a new ruling pops up. The big problem is FDA is sole regulator over ecigs and it isn't pretty.

    When I worked for USPS years ago shipping cigs was legal, people ordered online all the time. I had one customer that bugged me daily if her cigs showed yet LOL Them bam, something signed into law and no more cig shipments. It can happen overnight too. The USPS gets updated all the time on new restricted items or new country restrictions, like Canada has told the USPS no ecig shipments allowed to Canada because it is a restricted item. The regulations change fairly often especially overseas shipments.

    @Haktuspit - I was looking at eBay today earlier, when you said you wanted some more Kanger RBAs. IF you meant Kanger STM that come with the RBA...there's a seller on eBay, located in the US, and he's been selling STM clones on there (many of them so far), as well as other tanks.     Wait, wut? What $100 threshold? Stockpiling I've made multiple $300-$400 orders from heavens gifts slowtech, efun.top, etc, everything has just shown up. Is something supposed to happen to pkgs from China worth over $100...? How would anyone know, they all show up from random names and random address', i don't think I've ever received one pkg from "fasttech."
    I just bought 10 more nautilus bases (5 full & 5 mini) and 8 rubber seals from Aspire.
    The checkout page warns about keeping orders under $56 unless using DHL
    I split it into 2 orders of $54 each with free shipping.
    I rethought and asked by e-mail if they'd combine them for DHL to expedite them getting into US in time and send me a paypal request for the added cost.
    I received a reply that they'd combine them and ship them DHL for free as a courtesy.
    That's great customer service.
    I replied with a thank you but please send the request for the extra amount.
    I haven't received the request and don't expect to.
    No matter that I've ordered over $200 in parts over the past 2 years.
    Great customer service.
