Deeming Regulations have been released!!!!

    I just received this pleasant email from the Senator that I voted for. Unfortunately he is not up for re-election.

    We really need a listing of all the Congressfolks that are supporting this sham.


    Dear Jerry,

    Every parent in America wants his or her kids to grow up in a healthy environment.

    Congress passed the Family Smoking Prevention and tobacco Control Act in 2009 to help reduce smoking and to keep kids from getting hooked on cigarettes. Since then, big tobacco companies have continued to market products that weren't immediately regulated by this law, including candy flavored e-cigarettes, to millions of kids.

    The consequences of this loophole are crystal clear. In just one recent year, from 2013 to 2014, e-cigarette use among high schoolers tripled. Today, nearly 1 in 7 high school students, or two million teenagers nationwide, have used an e-cigarette in the last 30 days.

    That's why for many years, I've fought to push the Administration to finalize the blueprint that would regulate e-cigarettes and other new tobacco products that today are sold with virtually zero regulation.

    Last week, we finally got some good news.

    On Thursday, the U.S. Department of Health and Human Services (HHS) announced that the Food and Drug Administration's (FDA) tobacco deeming rule would finally be put in place. The new rules announced by the FDA ban the sale of all tobacco products to children under 18, require health warnings, and prohibit free samples.

    These are important steps, but there's still more work to be done to protect our children's health. The FDA's new rules don't put any limits on the sale of candy or fruit-flavored e-cigarettes, like 'Gummy Bear' or 'Scooby Snacks', which are targeted to children and designed to get them hooked.

    As a father and as a Senator, I am urging the FDA to move quickly to get these insidious flavors off the market, and to ban advertising aimed at our children.

    Nevertheless, this news is a significant milestone and a big step forward in protecting our kids' health. Please know I'll always keep pushing to protect our kids from nicotine addiction and to create a healthier America for future generations.

    That's the worst reply I've seen posted in my years on this forum.
    That's far worse than the boiler plate crap I got from Boxer and Feinstein.

    CASAA's CTA (the only live one ATM) is in support of the original HB 2058--not the Cole-Bishop amendment. The latter call has expired because it was addressed to the House Appropriations Committee (where it passed; 31-19). There is currently no active CTA from CASAA in support of the Cole-Bishop rider, which the letter from the alphabet soup is opposing.

    Whew.

    Somebody correct me, please, if I'm wrong.

    They renewed the general call on the 5th and it's still going around, but you're right, it does only cover HR 2058. Most have been adding support for the Cole-Bishop on their own since other associations have been calling for that. Hopefully, having most of the groups working together will get them on the same page at some point.

    My main point was how can you be disheartened by something you knew was coming..... :- )
    There's no $$ in the cure.
    They want us sick enough to need 3 ongoing prescriptions, forever...but healthy enough to work and pay taxes.

    ...as to your main point...you sound like my DH. :)

    A lot of us here are the original thread sitters when the NJOY, Smoking Everywhere vs. FDA case was going on. We're used to it. ;)

    The effective date of the regulations will be approximately August 10, 2016. Manufacturers will have two years from that date to submit PMTA's for every product (meaning every vaping device and every e-liquid) they wish to stay on the market. If the manufacturer submits a PMTA within this two-year period, it will be allowed to stay on the market for one additional year unless the FDA makes a decision on its application prior to that additional 12 months. If the application is not approved, the product must be taken off the market.
    And since I am assuming the $300K+ fee for the PMTA is payable upon submission then it effectively means we have two years because no one in their right mind would pay that kind of money up front.

    The money goes into preparing your application not to the FDA.

    I'm sure they're working on how they're going to explain that.

    They'll blame it on anything but themselves I'm sure.
    And most likely find a way to somehow blame it right back on us.

    Yep...Yep. The FDA will blame their inability to assess the positive change of the tobacco deeming regs, as it pertains to "youth and young adult smoking" (under the current deeming this now includes all American citizens from age 0 (invitro) to age 29) , to the massive amount of black and grey market traffic of vaping devices, E-liquids, and accessories.
