If you continue to vote for the group in power expect more of the same. Voting in the same corrupt groups gets us where we are. All they want is your money, this week they call it as what's best for you. Next week maybe it will be salt /sugar /potato chips/meat/the lovely gmo chemicals the establishment loves. It is time for people to wake up and research what these moneygrubbers stand for. Alas I fear it's too late. the public is so dumbed down they can barely make a decision on their own. Greed has destroyed the us. Now only corporations are people.

I just cannot imagine a modder making and selling a piece of metal box with a few electrical springs would be required to go through all that hoop. Words are very vague on pure hardware. Beside, the hardware is so simple (mechanical mods) that lots of people can make it themselves. There is nothing tobacco or nicotine related about a piece of metal or wood.

Perhaps they are confusing "hardware" with devices like Vuse of Blu?

They did say they don't cover "accessories."

I'd be interested in some Mexican sources. Nogales is right down the road from me.

ETA: I'm serious as well. I already go to the pharmacia for certain things that should be sold over the counter here, (e.g. antibiotics, modafinil), but are available by prescription only in the US, because of the damned FDA.

I agree with Rossum. There will be no vape police going after end users. Not a chance. It's all about manufacturing and selling. There is no law against building your own mod and using it. Making legally purchased hardware illegal to use after the 2 year window isn't happening either. If you have a life supply of gear you can use it until you die (assuming you can still find juice to put in it) and nobody will care

Just like brewing beer. You can brew up a keg of the finest IPA in your kitchen and drink it all day until you're wasted. But you can't bottle it and sell it or you are committing a crime.

Keep level headed about this everyone. Now is when the fight will actually start. The grassroots efforts of vapers contacting federal, state, and local officials could never have stopped this. Not that the efforts of individuals like many of us have made was worthless, it was just never really big enough to stop this from happening. Perhaps a better effort by industry trade groups, large activist groups, and a huge amount of small vaping businesses could have made a difference. But unfortunately, the small businesses never took this seriously and didn't choose to make a difference. Most vape shops I've been to never believed anything would happen... head in the sand I guess.

But until the deeming passed, legal challenges couldn't happen. There was nothing to challenge (this doesn't include separate state battles, just the FDA and Fed stuff). Well now we can and I think we will see a lot of legal activity starting now. So now is really when the battle begins. Hopefully an injunction will be the first order of business, and if that can happen we will have a certain amount of protection while the next 3 to 5 years of legal challenges occur. I would bet small vape shop owners will take it a bit more seriously too, which would be the biggest help in the legal battles.

Don't give up on the fight when it is just starting. Dig your trench a little deeper, hunker down, and be ready for a long protracted fight now that we actually have something to legally battle. We're not doomed yet, we're not even bloodied, but now there is at least something to fight.

I don't think you get it. Nobody is "FDA compliant" because they have not yet been approved under the new deeming regulations. And the chances of gaining approval are at least 1 in 1,000.

Sure, but Dekang is already registered with the FDA. That's a start. The FDA has approved their manufacturing facility and their process. From there, they just have to meet any new standards.

OTOH, smaller juice makers in the US will have a hard time meeting costly regulations and standards. After all, if you are a mom and pop business, the FDA could easily make your juice sales a losing proposition.

I was just mentioning that the large juice makers will survive this thing much more easily. It's going to be a tough road for small juice makers.

Hardware makers have two years to apply for and gain FDA certification. So, we all have a while to stock up on hardware and learn how to DIY.

Am i interpreting this correctly ;

- vendors have 90 days from today to introduce new products to the market without a PMTA application !?
- products currently on the market are ok until at least Aug 2018 !?


I've been waiting for this comment and sorry if it's been mentioned already as I didn't read all 27 pages here on ecf but I read it the same way.. After August 8,2016, no new products..

I think this link has some really important information how the regs affect vape stores, import/export and manufacturing. Vaporizers, E-Cigs, and other Electronic Nicotine Delivery Systems (ENDS)

It provides some easier to understand verbiage of the regs but also exposes some more ominous stuff that is not apparent in the 400+ page document..

This part,
Manufacturers

will kill a lot of liquid e-liquid manufacturers.. Good and bad in my opinion because there is a complete disregard or lack of knowledge with some manufacturers to provide correct labeling, testing and child resistant caps. These are the basics that the non-diy crowd should be demanding.

Another part in the original link: registration of facilities and liquids by December 31, 2016 will also bust a bunch of e-liquid companies..

The most troubling part about hardware for me however is this part:
Importing & Exporting

The effective date of this is unclear (to me).. Could be August 8th, 2016 or later? But this effectively stops all import of e-cigs as we'd go back to the mis-labeled or adulterated product game because nothing would have approval by the effective date by my best guess. E-cig shipments from China would be stopped and seized or sent back. Imports of tanks, mods, extracts, all considered as tobacco products, would be stopped. But what about if they are used for other purposes? Still legal to import? Who knows..

One last thought.. and I may be reading into this a little too much but by Jan 2018, all labels will be required to read,“WARNING: This product contains nicotine. Nicotine is an addictive chemical.”, if the product has nicotine or “This product is made from tobacco.”, if it contains no nicotine.. Makes me think that since flavors can't be regulated yet, that this labeling requirement is pre-planning for a potential tobacco and menthol flavors only future..

Did the SCOTUS do anything about the ATF and Fast and Furious? Who ordered that? Did the SCOTUS do anything about the IRS and the Tea Party audits and permit refusals? Who ordered that? Did the SCOTUS do anything about the EPA shutting down coal mining and other carbon energy operations? Who ordered that?

Well, the ATF, IRS, and EPA all fall under the direct control of the POTUS. They are not independent organizations that operate outside of the government, they are government entities that are under the direct command and control of the POTUS.

So if you want to know who ordered all of those things, it was Obama.

That's typical. Don't say anything in front of a camera that hasn't been approved by superiors for public consumption. Everyone answers to someone higher up until it gets to POTUS.

Yeah. Mr. Zeller wasn't exactly Bubbling with Information. And looked like he had been Barraged with Questions for about the last 10 Hours.
