California vendors mostly from what I have seen. This is indeed startling. My local BnM, with hundreds of 30ml bottles has nothing childproof or labeling of any kind. One hundred Teleos bottles alone, more....ouch
WEll, get down there and start buying to help them out. LOL j/k

I'm getting sick of hearing about kids. It's nothing more than a cute phrase to push their agenda. It's the parent's responsibility to make sure their kids aren't doing adult things. Kids aren't supposed to drive. Do we ban vehicles? No, in order to drive you must have a driver's license, which you can't get until you reach a certain age. Kids aren't supposed to own guns. Do we ban guns? No, you have to meet a certain age to purchase a gun (and go through gun control processes). Kids aren't supposed to smoke, but you can go buy a pack of Marlboros right now as long as you're over 18.

Maybe we should all still be in school and only given tasty sugary drinks after noon by our 'elected' superiors. I could go on, but I'm late for nap time. I've got coloring to do when my teacher wakes me up.

Wait, so the FDA can't even follow their own deeming? August 8th it will start, eh never mind July 26th would be better.

So follow rules as laid out here unless told differently without notice.

Man I hope a judge smacks these folks.
This is not the FDA. It is the Consumer Products and Safety Comm.

Coloring is good for relaxing :) We may all need to color to get thru all this LOL

This is separate from the FDA deeming regs i believe. The Child Nicotine Poisoning Prevention Act of 2015 was enacted by congress on 1/28/2016 and scheduled to take effect 180 days after enactment ( 7/26/2016 ). What has changed is the interpretation of the following by the U.S. Consumer Product Safety Commission:

any nicotine provided in a liquid nicotine container sold, offered for sale, manufactured for sale, distributed in commerce, or imported into the United States shall be packaged in accordance with the standards provided in section 1700.15 of title 16, Code of Federal Regulations, as determined through testing in accordance with the method described in section 1700.20 of title 16, Code of Federal Regulations, and any subsequent changes to such sections adopted by the Commission.

It seems they are saying that they misinterpreted the law in their previous guidance letter to the industry on June 7, 2016 !

Phhhht, one of our local news stations got 6 kids that looked 4 to 5 years old together around a table and put empty child proof bottles out for them to tinker with while secretly filming. They had 3 opened in less than 2 minutes. I thought it was informative but was a little taken back that they might have been inadvertently training them with the challange itself. Anywho, they are more likely to be senior citizen proof.

Well, they should have known this was coming. This is separate from the deeming. This SHOULD only effect leftover stock from the transition, but I'm sure there are some out there who haven't prepared at all.

What CRP Standard(s) did those bottles Conform To that were so Easily Opened?

Or were they just OEM branded "Child Resistant" without any Certification?

  1. What is a child-resistant package?


    A child-resistant package is one that is designed or constructed to be significantly difficult for children under 5 to open or obtain a harmful amount of the contents within a reasonable time. In addition, the package must not be difficult for normal adults to use properly.



    For a package to be child resistant, a total of 80 percent of the children tested according to the procedure summarized below must not open the package during a full 10 minutes of testing. Please check below for more information about the level of child resistance required during the first 5 minutes of testing.



    To make sure that adults are able to use a child-resistant package properly, 90 percent of adults tested have up to 5 minutes, and then another minute in a second test, to open and close the package so that it is child resistant again.

With my arthritic hands, I have to have the wife open some things for me.
I had to literally cut the child proof cap off of the last 2 liters of nic I bought from RTS. Just one more of the many "freedom of choice" we have lost :facepalm: In some cultures older folks are revered. Here we get thrown away "for the kids". :(
