Protect the children? What's easier to steal from your' parents, one cigarette from a pack of 20, or heavy expensive box mod? (or any mod for that matter) This is the same bullcrap that Bloomberg used in New York to ban large sodas. Mitch Zeller is a blind fool who is getting paid off.

For now we should calm down, ALL shops need to being filing lawsuits, it's on them to keep this industry going at this point. The cole amendment is on the AG bill and as long as we keep our politicians aware of who we vote for it'll stay that way. The shops that are not involved are not getting my money, the one shop I go to said they're prepared for the FDA, the owner didn't go into detail but I'm assuming he meant court.

I thought it was the age restrictions that go in at day 91 and the no new products.

Ok. Maybe that is what they were talking about. I was thinking that it had something to do with imports. I truly have read so much that it is all starting to run together though. Thanks!

Having once been the victim of an FBI raid on the offices of a former employer, I can assure you that you do NOT want to be in a vape shop or juice lab when federal agents come ...

That was over 20 years ago, and I still have chronic back pain from that day ...

"Breaking news local vape shop raided by ATF for selling illegal vape equipment, owner suffers a heart attack and dies." I hope they do start throwing people in jail, UCLA will sue them.

I just emailed the vendor I order my ADV from with information on the deeming, in case they were unaware of the details. I vape one of their flavors about 99% of the time and have for almost 4 years. I have a friendly relationship with them and asked to be kept in the loop about what they are planning to do (I buy online). I also told them that if they plan to stop selling, I would be willing to buy the recipe from them.

No. It's not the imports. It's far worse; it's everything not available in 2007.

You have 90 days before the law is effective.

T
That is not how I understand things. As I understand it everything on the market pre the end of the 90 days stays on the market for the 2 year grace period. No new stuff can be introduced though.

I work at a vape shop and we have now posted fliers informing customers of all that has transpired and how they can be heard. I urge everyone that works at one or frequents them to get the word out and get fliers out.

"Have now" ? please don't take this the wrong way BUT was the "vape shop" you worked in underneath a rock in the last year ?

The law comes into effect in 90 days, then anything has 2 years to seek approval, but can still be sold in the interim.

I'm not sure about new stuff. What's to stop it?

T
After the 90 days anything new has to go straight to the approval process and cannot be introduced without it.

My point was what we can get now we can still get for the 2 years it is not just gone in 90 days

"We have a very effective office of compliance and enforcement that will be monitoring and conducting surveillance to detect any kind of illegal activity in the marketplace," he says. "I have no idea what the likelihood is for a black market, but if that happens we'll find it and those products, if they haven't received marketing authorization from FDA, would be in violation of the law." - Mitch Zeller, director of the FDA's Center for Tobacco Products FDA

They do indeed! :D

Imho- new product enforcement seems like a logistical nightmare to enforce. China will keep shipping anything they want, vape shops will mix whatever, and mod makers will keep making mods. It's too muddy to effectively enforce. The breadth of the current industry is in our favor for a short couple of years.

I could be wrong but I doubt it. The "ignorance" defense is easy and likely unprosecutable. If I was a juice mixer I would just say "what?? I'm using the same damn flavors I've been using for years!" If I was a mod maker I would say "I'm using the same damn metal tubes and circuits I've been using for years?" If I was a Chinese manufacturer I would say "I have never given a crap about you or your mom or your stupid regs on anything so why should I care now?!?!?"

I know for certain that in the past 48 hours I have seen something quoted from the FDA saying that they will be prepared to enforce on day 91. What part of this exactly will they be enforcing on day 91? Does anyone here know?

I have read so much but, that keeps coming back to me. Seems like there should not be anything to enforce until at least 2 years from now?
I heard it, too. Day 91. It was Zeller, but I think it was his answer to a question about a black market. After 90, no new products can enter the market without passing FDA approval, but the black market won't get going 'till way later, like about 2-3 years. He's been distorting and dodging so much, I think he's got himself confused.

I hear you loud and clear! I complained TWO TIMES in 2002 when I lived in Silicon Valley abt getting ripped off by an employer for $35,000 on Yahoo! Finance and the FBI called me in. At first I thought it was a gag so I asked 411 for another FBI phone no and verified that they even had an office in said town. I went in thinking they would help me b/c I caught the Dir of Bioinformatics stealing data and shipping it to China.

They asked me if I had stock in the co. I didn't. Then they started screaming at the top of their lungs that I didn't have the right to pursue the $35k in any forum other than a court. When I asked them abt my Bill Of Rights, they told me I didn't have any...and started to toss me around the room.

That, THAT entire scene revealed to me that the FBI is unethical, immoral and the US Citizens worst enemy. Fine, they go after "bad guys" but they hire .... holes too. As a kid, I always saw the FBI as a great org. No longer.

I've read so much in the best two days, but I'm thinking this has to do with new products being introduced. Not sure though! By the way, it's nice to see you again.

I'm a bit confused about the 90 day thing. I'm a modder and there is this pretty cool mod that I've been brainstorming for awhile and I REALLY would want to get it on the market. Does this mean I have to do it in 90 days to be safe?

What if I can't make too much in 90 days, but I made a very small batch and sold it to people on ECF. Would it count as "entering the market"?
