People keep asking about the deadline, pass the following on.

@ECIGattorney, aka Azim Chowdhury who specializes in tobacco and vapor over at Keller Heckman tweeted the following: "e-liquids on market as of 8/8/16 can be sold until PMTA deadline on 8/8/18 and then through 8/8/19 pending FDA review".

Basically, it's just confirmation from an expert in dealing with the FDA that products on the market before the 8th of August can continue to be there until 8.8.18. If a PMTA has been filed during that time, they get an extra year after that for ruling. If they aren't filed on, they have to be gone.

10 settled lawsuits in the past 6 months?
Fontem (who makes Blu) - probably knows what they're doing. Cashing in their intellectual property before it becomes moot perhaps?

I've been seeing that Blu commercial on a loop. The one with the helicopter herding cattle. I gotta admit, It's pretty damn good advertising. I mean, it's heavy handed and ridiculous, but still...really effective marketing. I don't think they're going anywhere based on that. Just a hunch.

Thanks so much. AND, if the PMTA is rejected and or suspended anytime during this extra year, the party's over and the product must be removed from the market. :)

(leave it to this government to drop a 499 page purposefully confusing and frustrating document. And I'm absolutely sure it's intended to be that way to further their agenda. After all, vapers are just idiots who don't know what's going on, so the more words and complications we use the more we'll baffle them and get our monopoly and taxes. I am so sick of this government forcing THEIR agenda on us and having very little power to counter it. I'm 64 years old and I'm sad and frustrated that this is NOT the country I grew up in. My father, rest his soul, fought at Normandy Beach on D-Day to help make this country what it was. Which was free. But this admin is stripping that away. Very sad to see that happen:()

there are alternate uses for miost vapaor products, batteries, cotton, wire, I don't see how they can ban these they gonna ban vg/pg? its used in many many products other than vaping they gonn ban extracts? this is nonsense it will stop companies from selling juice but it wont eliminate vaping or ejuice you will just have to make your own. now what is the govt gonna do to enforce this? jail time for mixing juice? treat it as illegial drugs? the current laws don't stop people from growing "{other stuff}"

Try thinking about it this way, (sadly) if it contains the nicotine (I refuse to say tobacco product but obviously we ain't talking NRTs) or effects the nicotine or is a part of something that effects the nicotine, yeah it's regulated.

Even pipe smokers gotta deal with the double speak and craziness: pipe tobacco tins? Really? They say it's because something in the the metal of the tin could leach into the tobacco, I say they take feigned concern to a WHOLE new level.

Couldn't agree more. The prohibitive costs alone put all but BT and China unable to take this on. FDA know exactly what they are doing. All of the doublespeak and extended time for the approval period is a disingenuous attempt to total use ban and shutdown of the industry. Their far-reaching attempt to label the most obscure things that could be included in what constitutes a usable ecig is to the point of laughable. But I think is done to cover themselves in any lawsuits that may come up. FDA is not stupid altho these reg makes one wonder. They have a reason for everything they have put in it, we just haven't found them all yet.

I seriously doubt China will take this on. If orders get to be too few, which is also doubtful given the number of people that will be willing to risk a confiscated package for what they contain, they'll find something else to manufacture and/or copy and reconfigure the factory without missing a beat.

You are probably correct. I think it would depend on how big the US market is compared to the other countries they serve. The ecig business isn't going away all over the world, just the US.

ok say the fda does approve some of these applications it would be worth investing 50-100 million dollars if you are gonna control 10-30% of USA vapor product market you will make that back. some companys have the money or rich donars who will try.

If someone has that kind of money, or knows someone who does, more power to them. Of course, if the FDA says no, they don't return the money. If it's BT they can still kiss my backside, I wouldn't vape it if it was the last nic on earth.

First one out of the gate gets one less study they have to do I guess? Hard to compare your product to others on the market when there aren't any others on the market! :p
