If he's that stupid he won't be in business much longer.

He's been in business for four years... I'm just telling you what he said. It's because he owns shop he has to buy batteries within the USA he can't buy them outside the states. There's intent to use and there's intent to sell there's a BIG difference between the two. Other stuff is a good example. Where I live; intent to use you get a warning maybe a fine if the cop is in a bad mood. Intent to sell; you go to federal prison. If I buy tax free cigarettes for PERSONAL use it's legal. Now if I sell those cigarettes on the street I'm breaking the law.

B&M's in my area don't even remotely have his issue, I'm pretty sure he's totally not understanding the regulations.

None of this explains why he can't buy batteries from China and sell them in his shop. The batteries are made in China and are being sold all over the US. Retailers buy and resell vast quantities of goods from China. What does this have to do with avoiding cigarette taxes or selling controlled substances?

Could be, just figured I would share what I heard. Glad it's not true. I would rather shops use reputable sources and raise the cost than buy from China and get clones. He claims the source (who knows who that is) wouldn't even sell to him anymore. Either the source doesn't know or they got in a falling out and the shop owner is covering his .....

Because he owns a vape shop I guess. That wouldn't matter though because what company is going to ask if you plan on selling them in a vape shop? None, especially Chinese companies.

I say save some money, headaches and just get them from Liion Wholesale or IMR Batteries.

I just went to a different store. :thumb: It cost more but I'm impatient. I've never had any issues with all of my batteries (14 in total), I've got four HG2 that are approaching one year and they're still going strong. Still get the same watt hours I did when new. Only difference is they have new wraps on them.

Could be a language barrier misunderstanding as to the reason for not selling to him. A month or two ago I tried ordering some batteries, among other items, from FastTech and got an email that said:
We feel pitiful to notify you that USPS Expedited shipping service (FUSPS) can NOT ship parcels to United States temporarily due to more and more strictly security checking procedures recently.

After a couple of back and forth communications I figured out that they don't currently have a carrier that is willing to ship lithium ion cylindrical batteries to the US. I cancelled the batteries and the rest of the order shipped out the same day. Nothing to do with the FDA.

I bet you that's it. Shop owner probably thinks it's due to the FDA.

I got the same message, and I mean exact "We feel pitiful to notify" words. They did offer a different carrier option though which I agreed to and they arrived reasonably quickly.

I'm not caught up yet.
In fact, I'm only on page 677 at this point.

But what I am seeing is a whole bunch of quibbling.
The real problem is the extent to which the government is intervening in our lives.

We're trying to dissect a completely ridiculous set of regulations.
From a entity that is not even Constitutionally authorized to be issuing them.

The absurdity of it all is sometimes more than I can stand.
And what we need is REAL hope and change.

Yep, DC2. You're right on this. We went from a "Kitchen Cabinet" of around a dozen (?) to somewhere around 42-48 Departmental Tsars. :( Somehow our Reps. and Senators thought this was a good idea to grow the Executive Branch of Gov. In time it grew the power of that branch and reduced their own influence in the Legislative Branch.......How to make a King/Premier/Dictator.

Yes we need real change. We may get some. Can't say any more.

It should really be a regulation on nicotine, being the only tobacco derived product in the realm of vaping. I think Nicopure is stating that the FDA is out side of what they can legally do.

With all due respect, do you understand the Vaping360 article is a synopsis/breakdown of the document you earlier thought was insufficient?

Hi. The way I understand it is that Nicopure filed a suit. The FDA responded with a brief with their reply to Nicopure's suit. This article in Vaping360 is Nicopure's reply/brief to the FDA's response.

So it seems to me that they are 2 different briefs, not including the initial suit, one in reply to the other, not the same documents being compared.

Quote:
"The new filing refutes the FDA’s claims point by point." quoted from Vaping360 article.
