LOL, good one! It was a reply to someone who was worried that the new regs would limit them to 3 flavors.
One important thing. Nicopure who manufactures Halo liquid has made a move for all of us not just themselves.

• August 2016 – The guidance was updated to reflect the issuance of the deeming rule and the current range of tobacco products now subject to our authority. Note that the phrase "including as an aerosol (vapor) or any other emission" was added to the text under paragraph (a) in section III of this document.

I have asked about this also with regards to Feb 8th 2017/Aug 8th 2017 "Health Documents" submissions. But No One seems to know what a "Health Document" is?

Not likely. They have too much $$ to be constrained.... but this makes me think they'll be going after all flavors, claiming that the flavors, which we all love, will "initiate" vaping, and everyone knows stainless steel is a tobacco product....

Government overreach facilitates initiation of the use of tobacco products.
And/or massive amounts of alcohol.... And not in your ejuice!
Can't wait to see what type of self serving, gymnastics law logic the FDA submits today. If my math is correct today is the deadline for the FDA's counter response.

Where is the outrage?!? I guess our FDA jokes are true, cell phones ARE tobacco products. Seriously though, vaping isn't explosive, batteries are, by designe they are literally "stored energy". On a side note; I do hope the folks this has happened to are ok.

I think the date for them to respond by is 9/9 and oral arguments are scheduled for sometime in October.
I can sum up the FDA's rebuttal for you before it's publicly available. 20 to 30 pages stating "We're right, they're wrong!".
Don't forget the instructions to the judge, "Don't worry your pretty little head about the facts, we know what we're doing."
Yes, and it will focus on the FDA's touching concern for the cheeldreen, whose use of ENDS is [supposedly] increasing at an "alarming" rate. It almost brings me to tears just thinking about it. It's a winning tactic to portray your opposition as callously indifferent to the welfare of cheeldreen, particularly when your judge is a Jewish mom.*
*Not to suggest that mothers of other faiths, as well as fathers, don't care about the well being of children.
