Actually, my petition got pushback, from the advocacy groups, over the idea that vaping could and should be separated from tobacco.

I was unaware.

From the actual groups themselves?

We need a useful group.

If you're looking for the presence or absence of a particular substance, it's not. But doing a complete assay of what's essentially an unknown mixture of stuff certainly can be.

I guess. I honestly dunno about upper price range.

BREAKING (GOOD) NEWS: FDA TO ISSUE GUIDANCE DEFERRING DEADLINES BY THREE MORE MONTHS.

VTA has been working closely with Breathe Easier Alliance of Alabama (BEAA) on an administration strategy for the past couple months. Last week, we met with senior leadership at HHS emphasizing the need to re-evaluate the deeming regulation. Earlier today, Stacey Hamilton, President of BEAA and VTA Board Member, informed us that FDA sought an extension of its briefing schedule in Cyclops Vapor v. FDA so that the FDA could re-evaluate the deeming.

Sure enough, this afternoon FDA announced that it is doing so in all cases and that it is going to issue guidance to defer enforcement of all future compliance deadlines for all newly deemed products by an additional 3 months so that new leadership at the FDA and the Department of Health and Human Services can have additional time to more fully consider issues raised by the final rule that are now the subject of multiple lawsuits.

This is an important step forward in our D.C. efforts. Stay tuned for more to come.

More forward progress.

Time for a good push while we still have a chance.

Yup. I was told directly that not only are petitions useless, mine in particular was misguided because nicotine IS tobacco, and even trying to remove it from the TCA was detrimental to the tobacco harm reduction movement.

Didn't stop me.

Thanks for this!
The whole thing has been a tad depressing lately.
I was going to send a very disgruntled email to my reps tomorrow, now maybe it won't put most wanted list.

Yep  and I for one am very glad you persisted. I was floored when that happened. As far as I am concerned what we have been trying to do is the number 1 thing that needs to be done. Being deemed a tobacco product is what opens the door for everything that is being thrown at us.

Too late for my rep. I already sent him a disgruntled email. Of course he probably won't receive it anyway.

I signed it. I feel like any noise with a few thousand people behind it will be paid attention to. They know the vape vote is out there and petitions like yours prove that we ARE here and we ARE paying attention.
I signed it.

It made sense.

There wasn't a few thousand voices.

If that mattered it would never have got off the ground.

There's a webinar this afternoon at 2 pm Eastern discussing this and the non-inclusion of Cole/Bishop in the deal reached to avert the government shutdown for the next five months.

Ashley Davis and Malloy McDaniel from the Washington, D.C. lobbying firm West Front Strategies will provide an in depth look at federal legislative strategy. First, they will provide update on how things played out with respect to securing the Cole-Bishop Amendment in the Agriculture Appropriations bill, and how we are moving forward in the coming months. Second, they will discuss the murky legislative process in D.C., how bills become laws and, more importantly, which bills actually become laws and which bills don’t, and why.

You can register here to watch the Webinar if interested :

I'm glad it didn't Les. We worked pretty hard to get the wording right and get those signatures. The biggest backlash disappointment was from CASSA refusing to promote it as a valid method.

CASAA has dedicated people, and I try not to be disparaging. I was disappointed, though I understand their view in that they are not a "Vaping" advocacy group. I don't think all of the tools at our disposal are being utilized to their fullest, but I still send out their CTA's when I think it will help.

I do wish there was a unified front that all vapers could get behind, maybe someday. Until then I say we attack from every angle, at every occasion.

Not directly related to deeming, but further confirmation that second hand vapor does not expose bystanders to potentially harmful levels of chemicals of concern :

The Rest of the Story: Tobacco News Analysis and Commentary: Vape Shop Air Sampling by California State Health Department Suggests that Secondhand Vape Exposure is Minimal

"This study, although conducted under very high exposure conditions in a small, non-ventilated vape shop with many employees and customers vaping and clouds of vapor visible, did not document any dangerous levels of exposure to any hazardous chemical. Nicotine exposure was essentially non-existent. Formaldehyde exposure was no different than in many indoor and outdoor environments at baseline. Acetone, acetoin, other aldehydes, toluene, benzene, and xylene were not detected. Chemicals that have been associated with "popcorn lung" were also not detected by the standard method."

They must have all been using TC mods.

Those results are pretty much in line with what would be expected, and probably reproducible. However, there's no original source link. Not doubting Dr. Siegel, but when you have someone like the CA State Health Department kicking out such positive information, it's really helpful to be sure we know the context and the accuracy of that original source, especially before presenting it as "fact".
