Vape Shops Likely to Be Exempted in Planned FDA E-Cig Curbs

"Paul Blair, the director of strategic initiatives at Americans for Tax Reform and a proponent of e-cigarettes, said the comments indicate that the administration may exempt adult-only vaping shops from restrictions or bans.
“My hope is that this is an acknowledgement that vape shops should continue to exist and sell reduced-risk nicotine products to adult smokers,” he said in a phone interview. “If there is an exemption for vape shops, I think the administration has acknowledged the political and policy importance of preserving vaping for adults.”

Many have also Sighted/Argued that of All the FDA Warning Letters that have been issued for Sales to a Minor, that only a Few (like Single Digits) have be sent to B&M "Vape Shops". And that the VAST Majority have gone to Gas Stations and Convenience Stores.
I always say stereotypes exist for a REASON. It may be a sexist or racist one but they can still exist.
I don't so much hate Californians in general but the boomer ones moving out of state so they can spread their pollution and stuff everywhere... I knew we were doomed when I was waiting in a LONG line at Dollar General, and like, I saw theses candles on sale that said, "California scents."

Here is doubting that every single person in California or even in San Francisco is aligned with the 'Frisco view. I doubt that such a thought was intended expressed or implied, most on here are not stupid. That being said if I moved to California then Mrs CMD would also immediately institute a civil commitment proceeding, knowing that my mind had slipped a cog or two.

It seems that way. I have no problem with tougher age verification enforcement (like the proposed adult only vaping stores)--so long as we adult smokers or former smokers have access to vaping products. I don't even have a problem with paying a bit more in taxes.
I and many of us here have been fighting for this for years. At this point, I don't even fight for myself anymore--I DIY and I don't even care for most commercial eliquids; never even found my ADV. Just some juices that were tolerable/OK/not bad. And I mostly vape unflavored or barely flavored eliquids. Now I'm fighting for those who have never tried vaping or who are just starting. They deserve the same chance we got 10 years ago.

Depends on the menthol.
When I vaped commercial eliquids I preferred subtle tobacco/menthol blends like Drew's Nuport and BWB's Menthol tobacco or Halo's Menthol Ice, which is a wonderful blend of several different flavors.Would you like me to tell you what's it going to say?
Other than that, you know what they say--call early and call often.

I do NOT want tobacco flavored vape as it only makes me romanticize tobacco and want it again. Other flavors do not make me crave like tobaccos flavors do.
Please do not remove my freedom to obtain this much less harmful solution!"

On September 11, 2019, President Trump announced that the Food and Drug Administration (FDA) will finalize an enforcement policy to remove from the marketplace nearly all flavored e-cigarettes unless or until they comply with the Tobacco Control Act. Given the role flavors have played in drawing youth to these products, I strongly support this course of action and look forward to seeing the details of its implementation.
A 2015 report by the National Academies of Sciences, Engineering, and Medicine found that most adult smokers start smoking before age 21 and that increasing the tobacco age to 21 would save lives, improve public health, and reduce tobacco use initiation among youth. That's why on May 20, 2019, Senator Mitch McConnell and I introduced the Tobacco-Free Youth Act to raise the federal minimum age to purchase tobacco products, including e-cigarettes and vapor products, to 21. The bill encourages states to pass their own laws raising the age to 21 and allows states to enact higher minimums if they choose. I was pleased that on June 26, 2019, the Health, Education, Labor, and Pensions Committee, of which I am a member, passed the key provisions of our bill as part of the Lower Health Care Costs Act of 2019, a large package of legislation to address health care costs. It now awaits consideration by the full Senate.
Decreased rates of traditional cigarette use among youth over the past ten years have been accompanied by significantly higher usage rates of e-cigarettes. In November 2018, the Centers for Disease Control and Prevention published results of a survey showing that the share of high school and middle school students reporting e-cigarette use has risen since 2011 with an especially large increase from 2017 to 2018. The increase in youth e-cigarette use is likely due to the popularity of e-cigarettes shaped like a USB flash drive, which often come in child-friendly flavors, have high nicotine content, and can be used discreetly.
I am concerned about this uptick in youth e-cigarette use, and I have called on the industry and FDA to take action. In April 2018, I joined ten of my Senate colleagues in sending letters to the FDA about youth access to flavored e-cigarettes and the e-cigarette manufacturer JUUL Labs. We urged the FDA to take immediate steps to ban child-friendly flavorings and asked JUUL Labs about how its marketing practices appeal to children, demanding the company take steps to limit youth access.
I am also deeply troubled by the multistate outbreak of lung illnesses linked to e-cigarette use. Public health surveillance and data systems are essential to detecting health threats and expediting our response to save lives. The success of these surveillance systems depends on the ability of state, local, territorial, and tribal health departments, as well as other public health partners, to communicate with one another and accurately report their data to the CDC in a timely way. That's why on June 12, 2019, I introduced the bipartisan Savings Lives Through Better Data Act (S. 1793) to fund investments in health departments' data collection, transmission, and analysis capacities. I was pleased key portions of this bill were also included in the Lower Health Care Costs Act when it passed out of committee on June 26th.

According to the Centers for Disease Control and Prevention (CDC), nearly 1 in 5 high school students and 1 in 20 middle schools students used e-cigarettes and vaping products in 2018, representing a dramatic increase from 2017. While these products may benefit adults if used as a complete substitute for regular cigarettes, they are not safe for children and young adults. Most e-cigarettes contain nicotine, which can harm adolescent brain development and may increase risk for future addiction to other drugs. In addition, the recent increase in unexplained vaping-associated illnesses and deaths highlights the need for more research to understand the long-term health effects of these products.
We must commit to responsible measures to prevent youth e-cigarette use. In the Senate, I have cosponsored bills to restrict the sale of kid-friendly flavoring in tobacco products and to prohibit online sales of e-cigarettes to minors. I also said this elsewhere. Per my understanding of this article, only “non-kid-friendly” flavors are being considered for an exemption, which still leaves shops and consumers out in the cold.
No mention of deeming in the article.
Another hard slam on “agree.” It feels like the admin has their finger up trying to gauge which way the wind is blowing. This exception for Menthol/tobacco feels like throwing out a crumb. Already folks on twitter saying POTUS is winning their votes “back” if what Conway states in the article comes to pass, but I think most people are only reading the headline. So, who knows what the admin is going to do.They are probably still trying to figure out how to have that cake and eat it too.

The divide in Kalifornia is pretty much West and East. The big cities like Los Angeles, San Francisco, Sacramento, Oakland, Berkeley, San Diego, San Jose, Santa Barbara, Bakersfield, Orange county, and surrounding suburbs are extremely liberal where most of the rural areas are more conservative.

They have to allow it to be sold somewhere if they want to tax the bejebus out of it!
Actually they don't have to allow it to be sold somewhere. Policy makers have had the opportunity to tax e-cigs for years, yet their focus has always seemed to be on banning them instead of taxing them.
Conventional wisdom would point to their focus being on getting tobacco sales to increase rather than decline, to get the Master Settlement Agreement money back to the states where it once was ten years ago.
There are way more smokers than there are vapers. Therefore, tobacco makes more money for the government than does vaping. Follow the money.
