Whatever it is, this misguided effort to cripple vaping legislatively has failed and is now officially DOA. What the states will do is, of course, always of concern.
I have no idea what the FDA deadline will mean for us practically and what the new boss will do, but at least the FDA can't tax anything so we have a little room to breathe. At least until after the election.

Unless there is a knight in shining armor that saves the day, the Deeming will go thru in May. From there, it’s a matter of how strong Kyle Reese and the resistance movement is to defy the Cyborgs.
He could limit enforcement.
E.g. By telling the FDA to leave dedicated vape shops alone, just like the DEA leaves dedicated "dispensaries" alone in states that have legalized MJ, which is still a Schedule 1 drug on the federal level.
