
I expect the FDA to abide by the rules and not to be beholden to anyone especially big pharma.
Apparently that isn't how we play ball in the US.

The battery-operated device, known as an electronic cigarette, looks like a normal cigarette, but contains no tobacco and instead of smoke emits a nicotine vapor when the user inhales. Reps. Cliff Stearns (R-Fla.), Duncan Hunter (R-Calif.) and Collin Peterson (D-Minn.) have all been spotted using the device on Capitol Hill.
Chicago and Los Angeles are the only two places I am aware of at this time were it is being done. Think it may depend on who is working for whom as to what is grabbed.
This is exactly the way I understand it as well.I'm not an attorney, but it has been my understanding that Judge Leon's ruling (prohibiting the FDA from seizing e-cigarettes while the court case proceeds), which was recently upheld by the DC Court of Appeals, only applied to Smoking Everywhere and NJOY products.
Any other e-cigarette company that wants similar protection by the court (from the FDA) would need to petition to intervene in the case.
when dealing with elected officials, probably best to find a few who are already on your side, otherwise you are likely to get only a form letter for your efforts.

I'm guessing then that you would need to get an injunction to prohibit the FDA from seizing everyone else's goods.
It is really unfortunate the all the suppliers didn't try and join in as a group to fight the FDA.
I don't know if anyone else wanted to or were invited to align with Njoy but perhaps if some had taken the initiative this may not be happening still?
Mind you I am not faulting any of the other vendors but surely this was foreseeable?
Given the FDA's .... proclivities.

I had a similar situation back in late September. If I remember, correctly, the shipping carrier, TNT, said the FDA seized my shipment (LAX, eGo batteries and cartos. $500.00 + or so) and there was nothing they could do. They, TNT, were well versed on the subject and advised me to contact the FDA. I contacted the FDA Ombudsman and was told any e cigarette items from China were mandated to be seized.
