Morning shinies :)

It's too hot here :unsure: All winter everyone says it's too cold and then as soon as summer starts it's....Oh, Putain, il est trop chaud :D

The nearest of my packages has said ''on transit to the local sorting centre'' for 3 days now. So that's pretty unhelpful.....maybe today....or maybe not again

Same here. We had our first hot day yesterday- 88F. Every person I spoke to complained. Except my mom, who is also 88 and always cold. She sat outside for a bit, soaking it in. Folks were telling her to get inside - and I know, they’re her neighbors and they worry about her - but I told her as long as she feels good she should get that sunshine while it’s here.

Georgia doesn’t care to swim (but she sinks, so she wears a life jacket in case she falls in) so she cools off killing the sprinkler. Rudy plays with his frisbee on the raft. He seems to have forgotten how the game goes, but he’s still trying, crazy old guy.

Good morning shiners! It's the day before Friday!

Well, murder isn't a federal crime unless it involves a federal officer or some sort of interstate crime (kidnap in one state, kill in another, and technically they can try it, but more likely still tried in a state court). When things like a death occurs under circumstances involving say a racial hate crime, if the state fails to prosecute, the feds can step in but they prosecute for depriving the victim of their civil rights. I would imagine a state legalizing murder would find the feds willing to step in on that basis, as well as any federal court declaring such a law unconstitutional. Sounds clumsy, but it sorta works.

Edit: to clarify, we have three branches of federal government. The judiciary not only tries federal crimes but so can rule on state laws that infringe on constitutional rights. So there is some check on state law through the federal judiciary. But if it's not infringing on am individual's civil rights state law is deferred to.
Interesting...and oh good morning by the way. Hope you're well :)

So isn't there a case for infringement of civil rights in this case. They have clearly taken away from smokers rights to choose a safer alternative?

Aawh, that's really sweet....and the life jacket's is very fetching :) But actually though you've got to be careful especially when there are no steps as dogs can't get out.

Currently 35 degrees on our terrace.....95F

One would think. But the ACLU is so busy suing over other rights violations I can’t see how they’d have the resources to step up and fight this too.

The pool does have steps. And the first thing I teach a new dog, or visiting dog, is where they are. I gave her a reminder first thing yesterday too.

When kids come over, I do the same. The shallow end is just over three feet, the deep end about 5’ 5”, and there’s a ledge around the deep end. Nobody is ever unsupervised, but I show them how to get to a safe spot which isn’t more than a few feet away so they’re less likely to panic.

I've said this before on other threads (and got into trouble too) but that is a really stupid way of running a country.....there has to be a unifying federal force which has the last say otherwise all sorts of chaos ensues. France is a republic and has lot's of different states or communes and small things are done on a local level but the main laws come from central government and cannot be thwarted of disobeyed.

Let's just take and extreme example....are you saying that if SF fancied legalising murder then they could??

It looks odd to an outsider. I guess the idea was to be a brake on a corrupt or tyrannical national government. It probably made more sense in a sparsely populated rural country recovering from colonial rule. Government didn't have much role in people's lives back then.

Like if the feds tried to ban vaping the states could stand up for the people's right to vape. Trouble is the local governments tend to be even more corrupt than the feds in my opinion. A lot of States, like mine, are one party states. That tends to mean that the party machine runs the State and voters don't have much influence. Powerful State politicians made a deal with a big law firm and some vaping industry players to monopolise vaping in the State and tried to ban imports from outside the State. It was dropped because federal law enforcement moved against the corruption involved.

When the system was put in place States had less people than cities do today. States frequently overrule cities, though not all the time. Maybe the definition of local needs to be updated. My own township council is pretty democratic since everyone knows the 3 council members. Doesn't have a lot of power though. Trimming trees that hang over the road and so forth.

To be a right something has to be defined in the Constitution or a Court decision.

There are a few clearly defined rights though. They used to say in Britain the government could make it illegal for red haired people to grow beards and there was no recourse.

Well clearly this infringes an individuals right to choose...
