Jkm did you ever get any legal advice for this whole deal?
There is an attorney who I have had some dealings with in the past, and he said that this would be like any other small claims civil case, or we could all join together in a lawsuit. Overall I got the feeling that he wasn't sure that what we are doing anyway is legal, or something, and that's why I was thinking about a vaping attorney, somebody who understands us, and is familiar with the community.
I know there has to be someone who is an attorney and a vaper out there somewhere.
I am a vaping attorney, former Assistant D.A., just opened my own law firm in Scranton, PA. Unfortunately, I am not licensed in Tennessee so I am unable to advise on your case. But what we are doing is perfectly legal, and should be treated as such. Small claims civil case might be the answer...or not. What complicates the issue is whether goods were sold across state lines, jurisdiction and such. But I can tell you this, sometimes a nice letter from a lawyer telling the other party that a lawsuit will be filed works wonders, and voila, suddenly that person will begin to attempt to make things right. Also, if mail was involved, might want to notify the U.S. Postal Service, they take mail fraud very seriously.
If you look at my history on this site, you will see that I was scammed twice, and was able to recover not only my mods but many other members mods the second time. Scammer was hopefate, he came clean and made things right with every member he scammed. So I'm 1 for 2, lol...
