I went on vacation this last week to the town of XXXXville. My GF needed some unflavored juice to cut what I had made for as mine had too much flavoring for her taste. So we went out in search of some 18mg unflavored juice.
Found a shop that was still mixing juice in-house and got what we needed, at $1 per ml. I asked about the 8/8 thing and how that affected their juice making, and they said "as long as we dont introduce any new flavors, we are ok".
This surprised me, is it accurate, or are they deluded?
Or they may go for a long time before an inspection takes place if ever, who knows how many agents the FDA actually has in the field, and there are thousands of shops out there.To the best of my knowledge, the answer is... Maybe.
There is actually mention in the regulations, of "manufacturers" who did onsite, small batch manufacturing prior to 8/8 still being able to do that. The hard part is the other undefined guidelines, mostly regarding manufacturing facilities and processes. Then there's the issue of, no one knows who is a manufacturer and who is a retailer since no one is required to apply for either until December. So, they may or may not get shut down after an inspection.

Oh, if they are a manufacturer then I am a Laboratory!!!! I watched them bottle up the juice at a sink in the back room. I can honestly say my homebrew is much more well measured and sanitary than anything they were doing. Oh, and the unflavored 18mg juice was the color of honey........ About 5 shades darker than the strawberry/peach I had mixed.
A luke-warm mess at best. What happens when a business is in some technical violation of the FDA regs? The FDA send 'em a warning letter. First offense probably doesn't even involve a fine.
