PS mods if you feel this post is inappropriate, please delete it. Just trying to be helpful.
I feel it is appropriate given these shocking circumstances. Maybe when things calm down and we have some distance from the immediate release of FDA regs, things will get sorted and sent to the places they need to reside.

For now, we are letting quite a bit slide.

That's good to know. Someone should tell them.

"But Triplett's main concern is with the new testing and reviewing process. In 90 days, every vape shop will be required to submit their vaping products to the FDA.
Key word being submit. They have 2 years, (while remaining open), to submit their vaping products to the FDA, if they don't, then at the end of those 2 years, (not 90 days) they will have to close up shop.

And they have 1 year after submitting the application for it to be approved. If not approved within 1 year they have to close up shop till it is approved or declined.
Filing an application does in no way guarantee approval.

Is congressional approval all-or-nothing? Do they have th option of saying, OK to all but change the grandfather date? Or let stand age and labeling, but not the PMTA requirements?
From everything I've read all they can do is block the entire rule.

But if they do that then there is some very good news that goes along with it...
Because it "prevents the agency from creating a substantially similar regulation"

This is a good article which describes things fairly well...
The Congressional Review Act, rarely used and (almost always) unsuccessful

This is also a very good resource...
Procedure Under the Congressional Review Act
Your statement that only one rule in 20 years has been rescinded by Congress is incorrect.
Congressional Review Act - Wikipedia, the free encyclopedia
Actually, if you check that again, only the first example was successful.

Repost:

A 2012 investigation by the Associated Press found that the FDA had received nearly 3,500 of these "substantial equivalence" applications since the law took effect in 2009. The agency was expected to rule on these applications within ninety days of receipt. At the end of 2012 it had issued zero rulings, with many applications lingering for years.

(In 2009 the FDA began regulating tobacco.) Link to AP article: http://bigstory.ap.org/article/fda-review-tobacco-products-grinds-halt

I have a feeling PMTAs won't move any faster.

@robino, @classwife @retired1 or whoever knows what I'm doing wrong here. I wanted to just post a link to that live glossary, just like Kat did in her OP here:

Acronyms - What does THAT mean??

Spreadsheet

But it's not happening. If can fix my post, please do and I'm sorry.

Edit to add link...I hope: Nope....

If you want to add the spreadsheet, make up whatever name you want and type it into your post. Highlight the post then click the chainlink you can find in the top of the reply box tools. Paste the link into the box that comes up. :)

figured it out! Woot.

However, they said they will weed out poor quality applications that are submitted for the purpose of buying time, rather serious attempt at gaining approval.

I wanted to post just the link, like KatDarling did in her OP (see bottom of the page)...

Acronyms - What does THAT mean??

I'm so sorry--can you clean this mess up?
I don't know if the changeover makes just posting the link VERY difficult. I found a work around though. What would you like me to call the link and I can fix it up better?

Great, now zombies are a tobacco product - and not just the ones from ProVape.
ANTZ messing with our heads are now messing with new tobacco products that have not been approved as of yet. And they themsleves, are now tobacco products. We will be removed from the market along with them and all their bosses.

Alright, I'll stop now.

Good to know there are finally penalties for people who smoke, chew, vape or eat our brains.
This might turn out to be the best way to combat zombies.
If a zombie were to dare to eat our brains, the FDA can simply ban them!!

Could you please edit my post (#2154)? Just put whatever link works for you there. Call it whatever you want--Acronyms?

Thanks--you're a doll!

Maybe put the link between bracketplainbracket and bracket/plainbracket ?

I can't use the brackets in that, because it'll hide what you add.

IOW, replace bracket with [ first and ] second.
