I think he's implying that the Vuse is proprietary, which doesn't aid in our favor even though they are "approving" some vape stuff. What they're approving doesn't help the non-Vuse users one bit in what we're looking for in regards to regulations.

"On Oct. 15, the court temporarily stayed Triton’s MDO while its motion for a longer-term stay is considered"

"The FDA announced Oct. 18 that it has stayed My Vape Order’s MDO while it completes an administrative review of the order"

"On Oct. 19, the court temporarily stayed Gripum’s MDO while its motion for a longer-term stay is considered"

I wonder if this stuff will end up at the SC.

I don't know, but it could definitely be interesting to watch. There are five other cases pending in the same court that just spanked the FDA in the Triton case. I wouldn't be surprised to see the FDA rescind Triton's MDO just like they did TPB's.

    It should. Maybe some of the people up top are finally starting to scratch their chin realizing how f'ing dumb most of the people are that are supporting the enforcement of these regulations.

    In the FDA only a few people at the top are political appointees. The rest of them are career folks only motivated by keeping their jobs. Would they want to keep pushing something that looked like it was going down in flames, or look for a way out. They know if it goes wrong the pols would wash their hands and blame the FDA.

    Might have missed a post but what do you think about Altria pulling IQOS sales soon? Wasn't that one approved already?
    Altria Will End U.S. IQOS Sales November 29th

    The decision to pull it from the US market has to do with a patent dispute, not anything to do with deeming regulations or PMTAs. They are free to market IQOS in US markets as far as FDA is concerned and Altria would keep doing so if not for the patent dispute.

    Meh. Many (most?) of those "career folks" can easily enough get jobs in the private sector, in the industries that they now regulate, or in academia.

    Yeah, I forgot about that angle. Shut down vaping and you make BP and BT happy, leading to a nice job when you retire.
