Lol I don't blame you. I started looking and within 15 minutes my eyes were crossing. Then I got distracted by the serious lack of authorized AW IMR dealers in the states that aren't vape shops. :p

In one of the (Comments) it was suggested that some changes should be made in user fees. But in the (Response) the FDA basically said 'No' :- )

Having said that, it looks like we were all having a very civilized discussion until someone told us to stop bickering.

Bickering is stupid. Assessing our situation and figuring out who's with us and who's against us in this fight is a necessity. How on earth are we going to have a plan of action if we're not even allowed to name our opponents and our allies?

I live in California. Here's a brief history of anti-vaping legislation in my state--in a nutshell.

Industry hails veto of anti-smoking alternative bill as victory for consumers, common sense
Washington, D.C. – October 12, 2009 | Matt Salmon, president of the Electronic Cigarette Association (ECA), today praised California Governor Schwarzenegger’s wise decision to veto Senate Bill 400, which would have banned electronic cigarette sales in the state, protecting adult consumers’ access to these alternative smoking devices."

The public wanted to care in the beginning...
Until the lies started...

And in the end, it's the mainstream media that is to blame.
Some of us, even their own family and friends turned against them.

"Will the FDA issue a revised rule if there is sufficient data that finds that e-cigarettes are a safer alternative to traditional cigarettes? Please explain.

How is the FDA’s regulation of e-cigarettes not a premature restriction on an industry given the FDA’s admission that it does not have “sufficient data” about e-cigarettes to determine the effects on the public’s health?"

I posted this in the HR2058 thread but figured it was worthy of putting here to.

AEMSA hired a consulting/lobbying firm to push for approval of HR2058. Every day is a mix of good and bad news. Posting good news always feels better...lol

Does this Homeland Security & Government Affairs Committee really have the authority to get the FDA to reply ?

It will be quite interesting to see Califf's response to Sen. Johnson's letter, linked above. He gave them two weeks. Among other questions, he asks (paraphrasing): How many businesses will have to shut down? As the FDA claims it lacks "sufficient data" to determine the effect of e-cigarettes on public health, explain why these regulations aren't premature?

The FDA may 'claim' insufficient data but in the final rule deeming doc, they seem to have had a pretty good idea:

"Premarket tobacco applications, discussed above in section II.B, are expected to be the most burdensome requirement for electronic cigarettes. We expect to see adjustment through additional product consolidation and exit from the U.S. market, compared with what we would expect without regulation.

Yes. BIG Time. This is Very Good News.

The United States Senate Committee on Homeland Security and Governmental Affairs is the chief oversight committee of the United States Senate. It has jurisdiction over matters related to the Department of Homeland Security and other homeland security concerns, as well as the functioning of the government itself, including the National Archives, budget and accounting measures other than appropriations, the Census, the federal civil service, the affairs of the District of Columbia, and the United States Postal Service. The committee had been called the United States Senate Committee on Governmental Affairs before homeland security was added to its responsibilities in 2004.[1]The committee serves as the Senate's chief investigative and oversight committee. The chair of the committee is the only committee chair in the Senate with the power to issue subpoenas without a committee vote, though in practice, such unilateral subpoenas have rarely been issued in recent years.

Apparently they do... at the bottom of the letter:

The Committee on Homeland Security and Governmental Affairs is authorized by Rule XXV of the Standing Rules of the Senate to investigate “the efficiency and economy of operations of all branches of the Government.” Additionally, S. Res. 73 (114th Congress) authorize the Committee to examine “the efficiency and economy of all branches and functions of Government with particular references to the operations and management of Federal regulatory policies and programs.”
