Did a search, think it is the "Prevent All Cigarette Trafficking (PACT) Act" in 2010. Looks to be very cigarette/tax oriented, so I think that would need to be directly amended to include vaping devices...

My immediate, albeit emotional reaction is this: Forbes put this as a $3.7 BILLION industry worth as of last year. Who built that? Two entities. The creative and forward thinking individuals and companies who've given us all these great mods, liquids, coils and ideas, and most importantly, us, the consumers, tinkerers and innovators who've sustained and grew this phenomenal thing. We all need to stand up to this and not let a inept bureaucratic government take away the gains we've made, health-wise and individual decision wise. After 45 years of smoking and three years smoke free, I'll be damned if the gov is going to force me back to it, just because it's more monies in their pockets. And that is the REAL reason this is happening. I will go black market/underground if forced to. But I shouldn't have to! Not when cigarettes, proven deadly for decades, are on the open market for ANYONE to buy.

If things do not change in a couple of years we will have cigalikes maybe 2 brands with prefilled cartos in 2 flavors. Tobacco and menthol tobacco.
All owned and sold by tobacco companies.

Me? I will DIY. And use mechs once my regulated mods give out to the point I cannot repair them.
Have enough tank parts on the way to keep my STM's running for a couple of decades... Spares for my TFV4's, etc...

I have seen the date of August 8th too many times to think it would be anything different. It is my understanding that is when the 90 days ends.

It goes into effect the 91st day after after publication in the Federal Register, which is scheduled for 5/10. The gov. rarely counts the day of action as a day towards the 90, so I would think 8/10 would be the 91st day.

well given the intelligence of the FDA,, i think you and i will both be 6ft under by the time they figure it out........all we have to do is throw them some distraction bones,, like how bad soda pop is for kids,, and promote the idea to go after Coke and Pepsi instead.
Oh, that's next anyway. I guarantee it. Sin tax. But booze and cigarettes, both known killers, march on.

Here's the Deal.

Is anything that the FDA has released Final and Statutory without the Presidents Signature? As I understand it... No, it Isn't.
Can the President Sign the FDA's Rule Set before Congress (Both Houses) has Approved it... No He/She Can't.

The Congress/President Approvals are the Checks and Balances. Else the FDA could just put out Anything they wanted to.

I could be Way Off Base with this. But I believe that the 90 Day Grace Period ends 90 Days after the FDA Rule set goes to the Federal Registry.

Take a look at the Last Box in Step 9 in this Flow Chart...

Once the FDA's Rule Set gets to that Box, then I believe that the 90 Days will Start.
I think that although it must be submitted to congress by the FDA, congress doesn't have to act on it, and it would go into effect if they don't. If Congress votes to trash it, the President can sign or veto Congress' action.

There has been a lot of hang wringing over the FDA's intentions toward things like wire to make coils, ingredients for DIY and so on. I ran across this section. Note that they say "at this time" -

However, at this time, FDA intends to limit enforcement of the premarket authorization provisions to finished tobacco products. In this context, a finished tobacco product refers to a tobacco product, including all components and parts, sealed in final packaging intended for consumer use (e.g., filters or filter tubes sold separately to consumers or as part of kits). For example, an e-liquid sealed in final packaging that is to be sold or distributed to a consumer for use in a finished tobacco product will be subject to enforcement if it is on the market without authorization. In contrast, an e-liquid that is sold or distributed for further manufacturing into a finished ENDS product is not itself a finished tobacco product. At this time, FDA does not intend to enforce the premarket authorization requirements against such eliquids or other components and parts of newly deemed products that are sold or distributed solely for further manufacturing without a marketing order.

this is something I have been wondering about, if no new products can come into the US for sale after the 90 days how are retailers going to restock existing product, how will they be able to prove it was already on the market to the FDA, does this mean all shipments coming in will be stopped in customs again pending approval?

New Development Verses Currently available models.
