Which is not the same as how a court would view these things and that's ultimately where i think this will all end.

Bingo.So, I think that even though they were told in court they couldn't regulate vapor products as a drug, they just basically went ahead and did it anyway, just slapping a different title on it.
This leaves No Doubt that the FDA wants to "Clear the Deck" and allow Only a Select Few in the e-Cigarette Game.

IMHO if the only thing they accomplish is to let our opponents know we are still
here with out going quietly into the night so be it. Every avenue of approach must
be covered. Every angle of attack must be utilized. Petitions might not goad them
into taking action but, I don't see that is the point. They let them know we know.
In the wee hours of the night when they drift awake for a moment of conscious thought
and it comes to them,they know. That's enough for me.
Also take into consideration that due to economic and health related mobility and
other health related issues,petitions may be the only way for some to contribute to
the cause. Lets not dilute their modest efforts by not participating in these petition
drives.
