If the FDA had raised its concerns publicly, patient advocates might have been angry. But patients and investors might have forced Sarepta to begin a study comparing eteplirsen to placebo. Instead, we’re in a situation where the early data may be insufficient, and a study that is being conducted may not be enough either. This is a disservice to the patients who volunteered for these studies and to the patients who need this drug if it is effective. Another, similar drug, BioMarin’s drisapersen, was also recently rejected by the FDA.
It’s long past time to remove the gag on the FDA about companies’ public statements. This may require FDA lawyers to be more aggressive, or it may require an act of Congress. But patients are being harmed by this lack of transparency. Dashing patients’ hopes like this is cruel. We need clear standards.
