Not Sure how Comfortable I would be to have to give a Copy of my DL to a Web Retailer just so I could by a Coil Head for a tank.

“This product is made from tobacco.”
Right, utter madness. How can a nicotine-free mixture of PG, VG, and food flavorings possible be "Made from tobacco"? :confused:

I thought it said check the id's to see if you were of age before selling product, not take a copy to keep for their files.

So, my take on the Warnings and effect on Ruling:
Product packages and ads of covered tobacco products that do not contain nicotine may bear an alternative warning statement:

  • “This product is made from tobacco.”
  • Manufacturers must submit to FDA a self-certification
  • For more information visit FDA.gov and search for “deeming final rule”

We get this Struck down in Court, we then protect ALL incomplete Vapor products from FDA Regulation and have a NON-TOBACCO/NON-Drug Product on the Market for safer consumer use.(see black market nicotine dealer for upgrade)

Sounds Like it Frees up the FDA from Overwhelming Mountains of Paperwork/Sample Storage/etc. allowing them to concentrate on Fear Mongering and establishes a Canada style Vapor solution. :facepalm:

Actually it might be grounds to go to court.

Your Honor this requirement by the FDA requires me to LIE to my customers thereby setting me up to be sued by them for false advertising.

I think in the FDA's zeal to get a handle on vape products, they are thinking no one would notice how totally insane they sound. Surely they can't be that dense or desperate. Can they? I just cannot fathom how this will hold up in court.....

I think one of the court cases um... the place down in Florida has that in their lawsuit write-up. We will see how that goes, eventually.

Probably but people unfamiliar with write offs put to much emphasis on 'write offs' ( a common refrain in anti-business circles) ... as if they are total write offs, which they are not. I'm sure the tobacco companies would welcome the Cole/Bishop amendment, so they don't have to go through all of that.
Either way it goes BT is not going to lose any sleep over it. Their butts are covered either way.
Big government how ever knows on which side it bread is buttered. Vaping is not a long term
viable market for taxation.

in that it establishes more flexibility in Product they ultimately intend to control.
As stated - Even with a change in DATE, most prominent in the amendment, the Market goes into a Freeze.
One cannot control a product that cannot addict life time non-tobacco users.
The market will always need new smokers to feed into the vaping market to
make it a long term viable solution for taxation purposes. For this reason alone
vaping as it is today has to be eliminated.

Mail order ammo dealers in certain states (like the one you live in!) already do this kind thing regularly.

oops my bad, I read to quickly. I dunno, maybe some kind of system like age verifying can be done like they do some cc today, where the vendor never sees the actual card number.

The more I think about that, the yuk-ier I feel....goodby liberties. :(
