I'm a little confused, what are you talking about? The only standard I remember in the Cole-Bishop Amendment is the battery standard, which we REALLY don't want the FDA messing around with. Did I miss something?The thing I like in the Cole Bishop amendment which is not present in 2058 is the requirement for the FDA to spell out what requirements must be met for approval. As it stands now, even if 2058 passes and keeps everything on the market as of 2016, the current Deeming provides no real guidance on how new approvals will be decided and granted. You could spend $2 million dollars completing a PMTA only to have it denied with some vague suggestion on how much more crap you have to provide for reconsideration. Under Cole-Bishop, those standards will be known in advance of the 2018 deadline.
The other advantage to that disclosure prior to the 2018 deadline is the opportunity to challenge the basis of those requirements if they onerous, arbitrary, and capricious. If they are so onerous as to being impossible to meet, there is certainly a basis for legal action, as the Tobacco Act does not empower the FDA to outright ban tobacco products. In addition, knowledge of the requirements for approval will also allow a vendor/manufacturer to better estimate the actual cost of completing the application, and not simply rely on the "predicted expense" the FDA calculated. Under the current regulation, even if 2058 pushes the grandfather date to 2016, you would still have to literally complete your application blind, hoping you hit all the checks the FDA will require for approval (assuming there are any).

Thing is this, If it's only a few of us that are active we are just blown off. It's all a numbers game, if we as a community do this on a regular basis we will get noticed. But if only a few of us are active we're ignored as an acceptable loss and not threat to their seat of power.
Bottom line get active, regularly contact your Congressman and Representatives (write, email, webpage, Facebook, etc.). Cite "facts" and back up with the real science, great source is the National Health site in the UK, include things like the paper released by the Royal Collage of Physicians. Tell those in power to justify their position when the actual "legit" science supports Vaping and banning/restricting supports Big Tobacco .

The parties are both corrupt. What is going down has been going down since right after WWII but the plan is one that couldn't be forced on the population, it had to be slowly put in place...so we couldn't tell we were getting screwed until it was in to the hilt.
