FYI: Published today in the Federal Register:

tobacco Product Manufacturing Facility Visits

The Food and Drug Administration (FDA), Center for tobacco Products (CTP) is announcing an invitation for participation in its tobacco Product Manufacturing Facility Visits. This program is intended to give FDA staff an opportunity to visit facilities involved in the manufacturing of newly deemed tobacco products and their components and parts, including any related laboratory testing, and to observe the manufacturing operations of the tobacco industry. The purpose of this document is to invite parties interested in participating in Tobacco Product Manufacturing Facility Visits to submit requests to CTP.

I saw a post on FDA's facebook page a week ago from a medium sized juice maker complaining that he has sent 4 emails to the FDA about how to ensure compliance with the regs. They all went unanswered. Now the FDA wants to do visits. It seems pretty dumb and backwards that the "rule makers" don't even know what the rules are for a lot of this stuff. Confusing, messy, and muddy times ahead for juice companies. What a disaster.

I can see a temporary injunction be granted simply due to complete lack of clarity and guidance on a lot of the rules for "manufacturers".

Nope. I know of 3 that are laughing at the FDA right now. A little discreet packaging with no logos and labeling such as "light bulbs" goes a long way.

Problem is it does nothing for the Industry as a whole or the US FREE Market system.

China mislabeling of individual Purchases is Not any type of a Solution for the main stream.

Actually as I read the fine print the same thought flashed through my mind for a very small number of folks. :) The fine print from the Registry:

Final site selections will be based on the availability of CTP funds and resources for the relevant fiscal year, as well as the following factors, as applicable: (1) Compliance status of the requesting facility and affiliated firm; (2) whether the requesting facility or affiliated firm, if applicable, has a significant request or marketing application or submission pending with FDA; and (3) whether the requesting facility will be engaged in active manufacturing or processing during the proposed time of the visit.

So...say the giant Molecule Labs IMHO, would jump at the chance after they have entered the FDA PMTA death trap. :) BTW, PB recently announced that he quit his long time day job and went to work for them.

BTW #2 - My SO just informed me that she will not wear a hair net and a HEPA filter for our kitchen is stupid. /lol /joke

Explains why Phil looks so depressed lately.

Likely because you've bought into the lie that all tobacco products are dangerous. American chew and dip are almost totally harmless.

So true, vaping certainly isn't the first thing to be maliciously demonized by the government for nefarious purposes, that list is actually quite long.

Well, that's debatable here of late. And I was merely answering a question. I doth hereby beg forgiveness ye ole moderator-in-training.

Regardless, many here could soon find themselves just one lawsuit away from actually using the very tactics you so callously chastise. And while I won't detail such activities here on ECF any further, *I will* continue to provide information resources to anyone currently smoking and/or vaping that falls victim to FDA tyranny should the need arise.

In the meantime, you keep changing the world my friend. :)

I don't Chastise anything and am also fully ready for whatever future lies ahead. I simply point clearly to the Fact this is the least or our responsibilities at the moment.

Sorry If I came off to strong. We Do need to be prepared and we Do need to find Direction and Act accordingly in Battling this BS, Totalitarian action by an Agency given Free Reign to do as it pleases without accountability.

That's the problem, it's true. Nicotine -is- toxic at certain doses but then so is water. Water, (just like every other substance), can be considered a poison when over-consumed in a specific period of time. The only thing that separates toxic from non-toxic is dose over time. In normal doses/circumstances nicotine is no more harmful than the caffeine in coffee or tea. Yet I agree, watch how they try to take data and "normal use" far out of context to make sensational claims. I could make the same argument labeling water as a dangerous substance. Not only is it lethal at certain doses but empirical evidence indicates it's a precursor (stepping stone) to alcoholism. Every single case of alcoholism was first preceded by that person having regularly consumed "water"....

Totally agree, but the point here was 'what will they demonize next?' I chose "recycle old stuff" rather than something new..... :- )

Something I have been wondering:

Does US Customs have the authority, or obligation, to enforce "State" restrictions?

For example, if someone in Hong Kong sends something that is obviously vape related to someone in Arkansas what is the US Customs responsibility?

U.S. Customs will only deal with "Federal" constraints. They don't work for Arkansas.

In your example, they'll still most likely seize it. :)
