Most Industry folks are saying these estimates are low.


"This rulemaking would primarily impact those firms that remain on the market following the Deeming compliance period. The Deeming Rule will cause many existing firms to exit the market. Given our assumptions about the Deeming compliance period, we expect the Deeming Rule would also create significant market consolidation for deemed tobacco products by 2020. Some small manufacturers may exit the market or merge with other manufacturers to afford the compliance costs associated with the Deeming Rule. Other small manufacturers may expand production and increase their market share as their competition exits the market."

Then, after acknowledging that some (i.e. most) small manufactures will exit the market, they have the audacity to summarize like this:

"To summarize, most small entities would either benefit from the proposed rule or would incur small annualized costs of approximately $200. A few small entities may incur significant costs to submit PMTA bundles for originally regulated tobacco products, but these submissions would be rare and would affect very few small entities. For these reasons, we estimate that the rule would not have a significant economic impact on small entities. Thus, we proposed to certify that the proposed rule would not have a significant economic impact on a substantial number of small entities."

Talk about "spin"....

2. The bill makes no provisions that ban the import of the banned items for personal consumption, only for "sale or distribution." (Division A Title II Section 201 [14]). This is somewhat surprising to me. TBD?

I think that gets real fuzzy. I thought it was legal to import tobacco products for personal use. But then I saw this, ( I've quoted from this page. ) which makes me wonder if it will automatically become illegal to imports ENDS after Sep. 9th. that aren't in compliance with the PMTA process, etc.

Importing Electronic Nicotine Delivery Systems and E-Liquids
Tobacco products imported or offered for import into the United States must comply with all the applicable requirements under the Federal Food, Drug, and Cosmetic Act (FD&C Act).

You can also learn more about the importation process in the FDA Regulatory Procedures Manual, Chapter 9, Import Operations and Actions.

If you have questions about importing a specific tobacco product, please contact the FDA district into which your product will be imported.

There is some rumors right now with crytpo market that the ripple token is expected to hit 2k USD between DEC 2020 to FEB 2021.

The very worst that can happen is that the price just remains stable. However if this does indeed take off we could indeed give CSAA (Not sure on the abv. not checking atm) a massive funding stimulus.

Remeber at your own risk though, this isn't some spam scam post it is just a thought on how to unexpectedly counter anti vaping.

I can do this myself but based if this actually happens for the amount I'd be willing to donate may not be enough to match the pharmaceutical industrial complex.

You know, I'd want to say that they'd go after the vape shops here first. However, depending on China Relations and who is in charge, well I didn't read those links and now I cannot even claim ignorance though.

But, like I said, I really prefer to see what happens with good old fasttech tools/shower curtain departments before I decide to import anything.

I won a FT contest and I also got asked to do a review by Health Cabin but I have PMs proving I did so before the 9th, and like, etc.

It would make sense to go after the large importers first, who are planning on reselling. but nothing much has been making sense at ALL lately.

Personal Use

The FD&C Act does not exempt tobacco products imported for personal use from applicable requirements for tobacco product imports.

Importing and Exporting

Now.... We can do the "What is a Tobacco Product" debate for the Nine Hundredth and Eighty Seven'th time. But in the Eyes of the FDA, just about Everything we use is.

So if get a Form from Customs say'n that your Item is Not going to show up, because it is being Held as Evidence of a Possible Crime, don't be surprised.

I know Sept. 9 is the big talk lately, as it's so close, but what about the nicotine tax? I haven't seen anything regarding that since February.

Still pending. And so are state taxes. TBD. My governor really wants to tax nic also. So, depending on where you are, you'll probably get taxed, eventually. :D

I've Already Paid My Tax. It was called "Sales Tax".

If it were possible to make a concerted effort to get a good portion of vape forum and FB group members to do this, I recon each person would have to invest very little in order for this to bring in huge donations for CASAA and other similar orgs.

Oh, I don't know, foresight, planning and the willingness to go ahead anyway like, deserves some gloating if you ask me.

If you think it was easy obtaining 37.9 liters (plus one working liter) in one freezer AND THEN unexpectedly transporting it across country, well, it wasn't.

Nor was it cheap. Thank goodness for the husband understanding the importance of the nic, he plugged it in with an extension cord at every motel. But yeah, it was rough.

So, while it was also EXPENSIVE it is/was nowhere NEAR as much as it will be moving forward.

I am not gonna gloat personally (although I am on the younger side) but I will thank the lovely gentlemen with whom I WHOLEHEARTEDLY concurred the day I opened my first NJOY setup and it had the "vapeeverwhere card" which was a script to explain how you could vape ANYWHERE including on planes and I was like, "Oh. Vaping. It's good to get the word out but your time in THIS society is limited America is NOT going to stand for THIS."

I was shocked it lasted as long as it did, actually.
