Kinda'. The most likely interpretation by the ATC will be anything that is not a cig-alike and is used for vaping will be a vape pen.

Yes, the BT versions are exempt from all portions of the anti-vaping law in Indiana.

ATC is a very hidebound organization. Don't expect common sense from them. And remember, none of the bills provided funding for enforcement, so they can only fund themselves with permit fees and fines. They are able to levy some big fines by the law. Since the entity that enforces the law is also the entity that interprets the law...well you're all smart enough to know what that leads to.

Sec. 23. "Vapor pen" means a powered vaporizer, other than an electronic cigarette, that converts e-liquid to a vapor intended for inhalation.

How technical does this have to be ?
If I take my mod and tank - Well the mod is powered but does not convert e-liquid to vapour.
The tank does convert e-liquid to vapour but on its own it is not powered.

Sec. 9. "Electronic cigarette" means a powered vaporizer that:(1) is the size and shape of a traditional cigarette;(2) uses a sealed nonrefillable cartridge containing not more han four (4) milliliters of a liquid; and(3) is intended to be vaporized and inhaled.

Sec. 10. "E-liquid" means a substance that:(1) is intended to be vaporized and inhaled using a vapor pen. ( Well myself and many others don't use a vapor pen if going by your meaning of one.)

and - specifically excludes substances contained in nonrefillable sealed cartridges of four (4) milliliters or less used in electronic cigarettes.
( Strange so the liquid in those cigalikes an electronic cigarette as they mention in Sec 9 is excluded from being called an e-liquid. There what some big tobacco companies are selling are they not ?
Despite the fact that Indiana legislators came up with their own definition of "vapor pen", the language makes it clear that mod + tank = vapor pen. If you're looking to find a loophole I think you'd be better off putting a dripper instead of a tank on that mod.

Yes, officer, I'm vaporizing this here liquid, but it ain't e-liquid because I didn't inhale.

I see no problem with vape stuff and tobacco stuff sold together. Going into a smoke shop and making that impulse buy of vape stuff often is the end of the evil habit.

When the vape shops fill up with tobacco smoke, I'm not even going to walk through the door. I have read that many people did start vaping by making an impulse buy of an ecig at the corner market though so I get what you are saying. :)

Nope, 463 started as a cut in taxes for PX purchase cigarettes by military personnel.

539 and 1432 started and ended identically.

463 became a catch-all during late sessions required by the buget battles. It also requires summer sessions on 4 vape related topics, so we have that to look forward to too.

Hoosier, thank you for swinging by and informing us. Glad you guys are working on it. Any way we can help out? Is there a good thread to be following about this?

The first to post about things to help is either the Hoosier Vapers website (which still isn't fully recovered from the loss of our database server) and/or the Hoosier Vapers Facebook page.

I usually post in the CASAA sub-forum and the Hoosier Vapers social sub-forum.

BTW: There is a lawyer that is looking for donations for a federal suit against Indiana about this law. That is not us. We will make sure we have proper position in any suit we pursue and since the worst parts of the law will not be enforced until next year, we do not have a proper standing to have a real effect. (we would rather do it right than to do it first)

Showing up at the monthly Beech Grove meets would be helpful so folks can get to know each other, exchange contact info, and have a few laughs with fellow vapers.

Haven't been to this forum before. Haven't been to ecf in a long time, but it was here that I began. Lots has happened since I last posted, but I am still vaping....2 years and 5 months now. After 45 years on analogs, I am quite amazed that I got through a lot of high stress and didn't reach for a pack....as I always have done in the past. I have seen a lot of familiar names, and a whole lot of new ones....this is a great forum, and glad to be a part of it.

Two years and five months is fantastic. :thumbs:

You didn't mention your gear or juice. Do you rebuild?

Thanks agin Hoosier. I'm in California so will miss storming the capitol with you all. I'm not sure we have any Indiana folks on the porch but we'd like to help out. We're all in this together. Please let us know if there is anything we can do from afar. Agree completely about not jumping the gun with this. And thank you for letting know where to look for the informative threads. Keep up the good fight, we're rooting for you all!

That is so much the truth... So many do not realize that if one passes it - the others will follow...

And many believe that just because they are stocked up on supplies, there is no need to worry. Hello. I'm far more concerned about other people than I am for myself and them being able to start or continue vaping. If Njoy hadn't stepped in when they did, we all might not even be here on ECF let along trading recipes.

I wish there was a way to collect the data to calculate and analyze what would happen to the world;s economy and the world's governments if every one in the world just went cold turkey and quit smoking, vaping, snus, etc... all at one time... I think it would shock many.

All I'm getting, from a fast search, is from 2012.

Revenues from global tobacco sales are estimated to be close to $500bn (£316bn), generating combined profits for the six largest firms of $35.1bn – more than $1,100 a second.

All I'm getting, from a fast search, is from 2012.

That is sales worldwide and what I found was for taxes collected by state and local govt in the US - all big numbers. No wonder the want to hinder vaping.

I did a quick check, but the data is probably not complete. State and Local Tobacco Tax Revenue from 2012 for the US was 17,605,937,000. New York led with almost $1.7B.

That is a lot. I knew it was a lot but every time I see it, well, it's kinda mind boggling.
