Actually no I really don't think there will be heavy inspections. In such a scenario many vendors might be tempted to just keep quiet hoping to avoid paying the additional business busting PMTA fee and those choosing to do so would likely get away with it....at least for awhile. But if a disgruntled former employee (or ex-spouse/lover/business partner/rival etc..) reports the heinous "crime" the vendor would be investigated and could end up charged with knowingly committing a federal felony (or two or three). In America odds are they would end up becoming part of the incarceration statistic for the U.S. (1 out of every 115 adults) costing taxpayers around $50K per year to house for the next 5 to 10. :eek:

I'm pretty sure jail is an exaggeration. Fines, and products pulled from shelves for being "mislabeled" is what I think would happen.

Wondering if a PMTA approved product could be a 'predicate' for an SE request?? There is some indication of it in some of the guidance docs, but not clear enough to cite :- )
The FDA said yes. I think where I heard it was in an interview where Zeller (or maybe some other FDA person, but I think Zeller) said it in defense, responding to being questioned about complaints of the regs being too burdensome.

I couldn't even finish this. I'll be writing the producers to demand they present the full truth and get on guys like godshall, bates, Farsalinos and others as guests.

Go one better : Identify the manufacturers of the displayed liquids ( unless they're made up props ).
Tip them off about there juices getting slandered. Have their legal department write some not-so-friendly-letters to Hallmark and Dr whatchmacallit..

By now, the vaping community shold be done with .....-footing around...

The Founders could not have imagined that the legislative branch would willingly delegate the power to legislate to the executive branch.

The Constitution provides, "all legislative Powers herein granted shall be vested in a Congress of the United States.” In the 1892 U.S. Supreme Court case of Field v. Clark, the court said, “That Congress cannot delegate legislative power to the President is a principle universally recognized as vital to the integrity and maintenance of the system of government ordained by the Constitution.” However, subsequent court decisions have gradually eaten away at that principle.

Administrative agencies are supposed to administer public policy, not enact it. IMO, the deeming regulation is properly viewed as legislation, not administration. Congress didn't determine or contemplate that e-cigarettes would be regulated under the FSPTCA. That was entirely the FDA's doing. I would argue that in so doing the FDA made a fundamental policy decision which should only be made by elected legislators.

Is that what "a database of individuals whose age has been verified to be 21 years or older by reference to an appropriate database of government records kept by the distributor, a direct marketing firm, or any other entity" means? Sorry, it's not clear to me.

I ordered from Madvapes a few days ago. They have an age verification system. It could not verify me. I'm 41. I used my husband's name and he was instantly verified.

My first thought was: Yah. What about the furniture itself endangering the children?

Age verification for online purchases should have been anticipated by e-cig vendors for years. We all knew it was coming after Congress handed the FDA the power to deem and write the deeming regulations. It was inevitable from day one and nobody really opposed that. I'm surprised that some vendors are surprised and/or unprepared. CA laws only beat the FDA by two months. As of August 8th, every vendor in the country will have to be able to verify their customers' age--even if the Cole/Bishop passes.

Some of us oppose it, but no one that "matters."
