Why would Mr. Zeller be named as a Defendant?

Doesn't he work under the Direct Control of Califf?

I think maybe because of certain statements he made. Was it him or Glantz or both
that said nicotine derived from non-tobacco sources couldn't be regulated?
At any rate I would love to see both under oath in a court room.

I'll play the devil's advocate. I think they had to say we are in agreement with some regs. If this was prior to the hammer dropping, wouldn't be necessary but at this point, it would sound like we don't want any safety controls in place and that would not go over well in courts or government circles. I think we all knew there would be regulation, I just didn't think it would be this bad. I still hear folks saying, 'batteries can't be regulated' for years ago. Well, guess what? They can, apparently. I would not be trying to ask for more to get less, negotiating, at this point.

The main problem with this whole process was there was never any negotiating. None. Zilch.
I have always maintained the FDA was going to drop a piano on our ant farm and that's exactly what they did. To this day there is no reason under current law and regulations to even consider
regulating anything in the e-cigarette industry because aside from equipment failures they
cannot find anything harmful to otherwise healthy individuals. To regulate something as harmful
the bare minimum requires it to actually be harmful. There is no such proof and day by day it becomes
more likely none will be found.

Sucking all that stuff into our lungs cannot be healthier than not sucking it in there.
Then comparing it to unhealthy diets?
That was not my point, vaping is less unhealthy than lots of things we do but not more healthy than not vaping.

If one considers the impact of vaping on otherwise healthy individuals there is still no
indications of any long term negative health concerns. There should be some by now.
It's not like an alarm clock and ring,ring,20 to 40 years down the road everyone gets
COPD or something.

At this point in time I do not see it as unreasonable to assume vaping may
not be harmful at all. My chronic persistent bronchitis is gone. Due to my advancing
age I have other issues but,breathing isn't one of them.

I find this article truly depressing:

If Mr. Zeller had the Ultimate Authority for the content of the Deeming Rule Set, then Yes, he would have been Listed as a Defendant. But he Didn't. So the Lawsuit is addressing the Responsible Parties at each level.

Not saying that I wouldn't Love to see Mr. Zeller have to Testify under Oath, either in Federal Court or in an Oversight Committee Hearing, as to How some of the Particulars of Deeming were established.

Or to see him pull out a "Pear Harbor File" filled with CYA Docs as to How Deeming was done.

And it gives me a Very Warm n' Fuzzy feeling that the FDA has Nothing to Hide. And was/is acting 100% in Good Faith when it took this Science Based approach to Regulating e-Cigarettes.
