Thanks that I pretty much what I thought.
thanks to Kent for the clarification though I thought it would require a committee vote. I suspect they would get a new chair if he issued it on his own....

A bit more on the 'prompts/letters' - here's what he said in the last letter:

Please provide this information and material as soon as possible but no later than 5:00 p.m. on June 20, 2016. If the FDA does not provide an adequate response to these inquiries, the Committee may be forced to resort to other means to compel the production of this information. Thank you for your attention to this matter.

And yeah, as far as subpoena - he's the only Chairman in the Senate that can issue a subpoena without a committee vote.

Here's a radio program he did, where he goes into more detail, in case you're interested:

between here and there
That's why I think that if all this was just posturing he'll loose a good amount of support and credibility with his constituents (I'm sure I borked that spelling up).

See, I don't think he will. If the FDA did over reach Congress' intent when they gave FDA the authority to regulate ecigs then this certainly would make the FDA the 'bad guy' in this situation. There is so much 'behind the scenes posturing' that we will never know exactly what goes on intra-agency. So, we wait and see.

I will be VERY pleasantly surprised if the subpoena is issued.

Has anyone wrote letters to the rest of that committee?

I did. You can email the committee directly and I also emailed my Senator Rob Portman as well as Rand Paul (I subscribe to his newsletter) :- ) I got what I would call a 'good' reply from Portman and none from Paul, but as happens, they only respond to their own state constituents. I got what is probably a 'canned' response from the committee but it did mention the issue. :- )

Now that is funny.
Supposed being the key word....
There are a myriad of agendas in our government.

Deal making for votes.
You get my son in law a job and I will support your bill and such thing are the most harmless of them. but all added together = big corruption.

That's why I put it in Italics.

;)

I'll be Honest with you Robert, I'm not exactly sure where you are going with the Johnson Creek, Money, Senator thing?

Everyone knows that Money Talks in government. Only Fools and the Tragically Naïve don't. So shame on State e-liquid Companies for not Pooling some Money together and getting the Ear of a Senator/House Member or two.

Rotsa ruck with that.
I got a canned response back from his office indicating no support for vaping.
He will support BT but aside from what they already have lined out with the FDA....

Yeah... It wasn't anything that I would consider to be Serious Support of e-Cigarettes.

UMM the CEO of Johnson creek met with him and is mentioned by Johnson.
Influenced for sure. How much and in what way is the only question.

I honestly don't understand what your problem with Sen. Johnson is. Seriously... We have all been asked to petition our lawmakers--vapers and businesses alike--and beg them to help save vaping. I did it, hopefully you did it also, so did Johnson Creek, CASAA, SFATA, AEMSA, etc... We have a right to petition the Government. Why are you insinuating that the Senator and/or Johnson Creek did something wrong????

Right to petition in the United States - Wikipedia, the free encyclopedia

In the United States the right to petition is guaranteed by the First Amendment to the United States Constitution, which specifically prohibits Congress from abridging "the right of the people...to petition the Government for a redress of grievances".

Robert, I'm sorry, but I also am getting this odd sense that you are having a problem with those who are supporting vaping. I hope this is just a matter of misunderstanding, but you seem to be against Sen. Johnson.

I would very much like links to the info you posted about him, and Johnson's Creek.

Robert has already corrected that - a few pages back now lol. He has more data now on the whole Johnson question.

They've been too focused on "Clouds Bro" B.S. cloud comps, idiotic marketing, etc. Essentially the "quick buck" instead of looking beyond their immediate noses. Much like most of the online and B&M's, they should be telling everyone who comes in their door, hits an online vendors website to get active and vocal.

But nope, still thinking someone else will do it for them.

It's not like their business and jobs aren't on the line ya know............. [emoji22]

Question: what is the shelf life of flavorings?

About two years! Cool and dark place with a stable temp like your cabinet or a drwaer. NOT in the refrig or freezer. Confirmed with three vendors. Including FA!

Back on topic: "ENDS can apply for SE once a product has been approved via PMTA." The problem with this argument to name just the major one is that the FDA has only approved ONE PMTA. I repeat, ONE. :) See uncle Bill Gs post on this issue and:

Swedish Match North America, Inc. First to Cross FDA’s PMTA Finish Line

Heck, they even brag about it: FDA issues first product marketing orders through premarket tobacco application pathway

:)

Do we know how many applications have been filed and therefore denied?

Perhaps this will improve the spirits of one or two folks.

Two local B&Ms held an all evening fundraiser for CASAA & legal activity, this past weekend. Info on deeming was readily available, as were broadsides on A Billion Lives. The event was well attended.

IF IF IF one gets thru the PMTA, , ,

    but WAIT, there's more!

"Now that these products have been given PMTA marketing orders, they may be introduced into interstate commerce. The company is required to report regularly to the FDA with information regarding the products on the market, including, but not limited to, advertising, sales data, information on current and new users and adverse experiences. The FDA may withdraw a marketing order if it determines that the continued marketing of a product is no longer appropriate for the protection of the public health, among other reasons."

I see. So if someone is, say, 40 years old and lives to 80 is it possible to,

    A) Afford to buy 40 years of vape stuff all at once, and...
    B) be assured it wont go bad before he/she turns 80 (especially given the investment stated in A)?

I think it is possible and worth the risk which is very low imo. YMMV :)
