Someone else just pointed this out though. Darn it.

On August 8, the FDA issued a direct final rule (with a companion proposed rule) describing when the agency would refuse to accept a tobacco product application. Due to some significant comments received during the 30-day comment period, the FDA is withdrawing the direct final rule. The FDA will consider the comments received and will proceed with the proposed rule, which was issued concurrently with the final rule, through the usual rulemaking procedures.

Under the proposed rule, FDA would refuse to accept a tobacco product submission, for example, that is not in English, does not pertain to a tobacco product, or does not identify the Start Printed Page 52372type of submission. By refusing to accept submissions that have the deficiencies identified in the proposed rule, FDA would be able to focus our review resources on submissions that meet a threshold of acceptability and encourage quality submissions. If we receive any significant adverse comments that warrant terminating the direct final rule, we will consider such comments on the proposed rule in developing the final rule.

Sounds like they just figured out where all the ecigs come from.(or someone let them in on the 'secret') So with the exception of Provape there are no manufacturer of ecigs here in the US...someone correct me if I am wrong. Wondering whom it may be.....???
Guess they have the look of a deer in the headlights. See,,, alway do due diligence....LOL

eta: also if the judge rules that zero nic is not a tobacco product then guess what most of the vendors will sell from now on......

For myself, I told of the FDA's overreach in their regulations is helping to close vape shops. Mom and Pop businesses that employ people, pay taxes and help the economy. I also shared a small part of my personal story. I tried to emphasize the fact that these are not big tobacco in any way shape or form. That vaping has helped many hard core smokers quit smoking.

I'm hoping that just mentioning the draconian regulations that the FDA has enacted will help sway him to our side... just possible?
