Well, given nicotine itself is for now legal, I don’t think possession with intent to sell would stand up like it does for illegal drugs. They’d probably need to make a sting buy from you, so don’t sell to strangers.

Every ban or restriction I’ve read about refers to sales, and all I’ve read about statutes or regulations that are in effect or have been proposed, do not restrict personal use.

That said, I would agree bragging to people who know where you live that you have a 50 year supply of nic in the freezer would be poor judgement.

Actually the word "sales" is rarely referenced in Final Guidance. It's marketing (appears 3 times as many times in Final Guidance as the word sales). Primarily advertising, but yes that includes selling. Black market is either barely alluded to or not at all mentioned in Final Guidance. I'm sure it's assumed within the language. But the political reality, is that it's a whole other market.

You think hoarders will be treated kindly by all people in a community, I find that laughable. Like a person getting busted with 25 pounds of pot, claiming it is all for personal use. Fact is, they could be 100% telling the truth, but I doubt you'd find anyone that believes them. So yeah, all vapers sitting on 30 liters of nicotine, may claim it's for personal use. Better hope no one ever finds out about that stash. And I mean no one (no family nor friends) or you'd stand as much of a chance convincing them it's for personal use as any black market operator.

Dang, in my (2) previous posts on Final Guidance, I admittedly missed the part where they bring up "Avoiding a black market," in the Guidance. They almost devoted a full page to this. If that weren't funny enough, the words they chose are simply hilarious. Like this example:

Additional potential actions against adulterated or misbranded illicit tobacco could include: (1) issuing a Warning Letter; (2) issuing an import alert and refusing admission of tobacco products imported or offered for import into the United States; and (3) initiating seizure or injunction court actions. Persons engaging in illicit trade in tobacco products may also be criminally prosecuted under the law.

As a result of this policy, FDA will be better situated to combat black market products...

LMAO.

Good luck FDA and anti-vapers. You're going to need it. I predict you fail badly. And again, I rejoice.

Can you point me to the PMTA for liquid nicotine?

Cause in my reading of final guidance, I would conclude that liquid nicotine is an illegal product. I hope I'm mistaken.

We might get a little advance warning on that one. They can't just make it illegal for sale because it's used by tobacco companies. They would need to put something in place allowing it to be sold commercially to approved buyers, but not retail. I don't know who would need to do that. Could FDA or someone else just put out a reg, like some intended use rule? Or would it need a law to be passed by Congress. They are talking about a huge new tax that would make buying it impractical for individuals, but they might have to find a way to exempt tobacco manufacturers. It could be done but it seems like it might take some work. In the UK it can only be sold in small quantities and low concentrations, except to licensed companies. That took a law.

I've never seen it mentioned in any official document.

She's one of my favorite memes (Google "Crazy Girlfriend meme"). I use her a lot.

    Hate is a complicated feeling, you need to fell in love first then slowly ruin your relationship, run through some bad life decisions, loose a friend and a partner and only then you can start hating.
    So it's not "Just", it's a hell of the work :thumb:

    Actually dream...that post was mostly a joke...(but NOT the two 5-year marriages part)...

    In reality...I figured out that I have a repertoire of about 5 years of jokes...after 5 years I start repeating them...and my wives were..."They weren't that funny the first time around...I'm certainly not going to stick around for the repeats!!!"...

    (When I ask the current Love Of My Life...who I've been living with for 30+ years...[with NO thoughts of marriage]...why she didn't laugh at one of my jokes...she always says..."Because I was afraid that I'd miss the next one!!??!!") :shock:

    Oh, and single use e cigs like I guess prefilled pods. Don’t these people have like real jobs, or do they just sit around dreaming up the next stupid thing to do?

    Next up, no more single use diapers. Back to cotton diaper clothes and safety pins.

    I'm tell'n ya. They're sabotaging the cigs as much as possible. Same with the fire-safe nonsense too.

    You guys think I'm crazy, and it's only the money. But when you see stuff like this wow.

    I will admit that butts are a huge pollution source, so if they mandated a different material for them maybe it would make sense. One that degrades better. Hell, you might be able to make a filter, not from that cellulose, but from tobacco plant scrap fibers or something.

    The maybe incapable of recognizing a real problem but, I am certain that should they accidentally stumble onto a real problem they will be incapable of addressing it. Action upon or even musing upon a real problem may hurt one's chances at re-election.

    Any legislator can create a bill and submit it for consideration. The overwhelming majority of bills go nowhere. I haven't noticed anything implying the federal government plans to sanction possession for personal use. So far there is no Federal sanction relating to manufacturing so long as the products are exported, not offered for sale in the US. May be Massachuetts new law allows for fining citizens for posession of vape stuff if they can't prove their new tax was applied. I'm not certain whether that made it to the final version of the law. I won't be traveling to MA.

    The states and congress jumped in front of the FDA, who had their own game plan. Normally there would be investigations and hearings over some years for an issue like this. Skipping that process will bite them in the .....

    If there is a black market I predict it will be small packages from offshore.

    I foresee things like "Benny's Blackmarket Basement Baragains" popping up. They start out sneaking in shipments from overseas to supply themselves and close friends and family with hardware and nic... but slowly the word gets out that someone in the family "has a guy" and then it slowly turns into side income instead of just family and friends.
