Pages 36 - 41 of this new GAO tobacco tax report (released April 18) cite some internal actions the FDA has, is and/or maybe taking towards developing the "deeming" regulation for unregulated tobacco products (e-cigs aren't mentioned, but rather cigars and pipe tobacco, which are also unregulated products).

On page 45 of this document it states,
"In a 2009 report on the federal rulemaking process, we found—based on an analysis of 16 rules at different federal agencies, including FDA—that the average time needed to initiate, develop, and complete a rulemaking was about 4 years, with considerable variation among agencies and rules."

Does that mean since the FDA has already completed the "initiate" stage and are now in the "develop" stage, that we have approximately 1 1/2 to 2 years before it is completed/implemented?

Don't know, myself .. but here's a thought more and more people are going to want to start thinking about ... stockpiling DIY supplies, at the very least in a large enough supply that if it comes down to having to stop altogether...those who need to can gradually reduce the nic level down. Hopefully they can't attack the hardware itself or juice without nic in it. You can't classify a product with no nic in it as a tobacco product. The reason that is worth mentioning is even at 0 nic you can still vape ... the feeling of vaping would still be there, just not the nic.

I've been wondering about this too. AdariousMistdancer. Surprising how quiet it is on the forum, when the ax is about to fall on us all. I guess, they don't want to start a panic, but the FDA has got a devious plan to oust the availability of nicotine self administered. Just wait, you'll see in a couple of years, Pharmaceutical companies will re-issue vaping, under Dr. supervision, it's all about money and we better stock up! Thanks for speaking out.

I don't see there as being much that we can do, if anything at all. Money talks louder than words and protests in America and lobbyists and large corporations have a lot more of it.

Then there's the subject of what they can control.
They can't control someone going to radioshack and building a box mod then buying batteries online.
They can't control the juice itself, anyone can and will still be able to buy PG, VG and flavorings.

So the only thing they can control is nicotine, cartomizers and atomizers because those are still mostly imported from overseas.

So, before the hammer falls.

1. Buy a Genesis-style atomizer system and rebuild it whenever it needs rebuilding.

2. Don't buy pure-nic because it doesn't last, it can't be preserved.

3. Taper off of your nicotine content in your juices.

There is always growing it, drying it and extracting it ourselves. What about the stillers during alcohol prohibition? This the nicotine prohibition era, that is what it is. I have thought about it. Did nicotine addicts cause harm to society, such as violent crimes, vehicular mayhem, murder, domestic violence well alcohol is attributed to these evils in our society, alcohol is found to be involved in nearly all of the above and remains available, affordable etc., Yet, nicotine, which is no more than a cup of coffee as far as stimulating or mind altering, is now the WATCH OUT DANGER DRUG!!! I don't have the where with all to grow my own, and do all the processing, so when they outlaw the sale of nicotine, I am sure it will arrive black market. Then the FBI and all the other Federals will start gun battles and break up nicotine parties. By the way Dr. Venture, your caricature is nicely done.

We can try to get Congress to take away deeming regulation for e-cigs from the FDA, but I think a lot of people believe that is a long shot. More likely, the FDA will propose regulations and open them for public comments. At that point, we lobby like crazy to make sure they are reasonable and beneficial to the health and safety of vapers and other smoke-free users. Hopefully, we'll have the backing of our new "friend" in e-cigs (Lorillard) with all of their lobbying money and influence. At this point, it's wait and see. The vaping community doesn't have much to rally around yet.

The conversation is kind of like this:
"We have to fight the FDA!"
"What are they doing?"
"They might regulate e-cigarettes in a horrible way!"
"What horrible regulations are they proposing now?"
"We don't know yet."
"Well, when are they proposing the new regulations?"
"We don't know yet."
"Umm..OK, well, get back to me when you know...."

It's kind of hard to rally the troops around that, you know? I think most people are waiting to find out if there is even going to be something to fight against?

I have been unable to attend casaa meetings, my own personal life's chaos, got pretty out of hand. I appreciate you helping me know what I didn't, even though we all still don't know. Also thank you jimbill for that info. I hope some how to be able to afford the investment, if it becomes obviously necessary or I look at ways to cut my nicotine down. LOL why that one seems so hard to deal with.

I understand completely. I had to retire slightly early because work was interfering with the things I had to accomplish on behalf of CASAA. So now I work 24-7 voluntarily and don't get paid. But I am rewarded in other ways. Like when folks like you experess your appreciation.

Aw, shucks, you made me blush! :oops: Thank you, that was very sweet.

It's good we are on the same wavelength, because I don't have permissions to post in certain sections on ECF and I often see you posting what I would want to say! ;) Don't discount everything you do - CASAA needs people to spread the word and you are one of its biggest cheerleaders. All of your efforts to raise awareness of both the cause and CASAA are GREATLY appreciated!

Yes did a test and put unflavored 100 mg nic in 3 glass bottles 7 months ago. First bottle went in freezer, 2nd in dark cupboard and the 3rd on top of cupboard. The only bottle that is still crystal clear is the one in the freezer. The other 2 can still be used but rather than being crystal clear they are dark to the point of dark brown.

The chemist here on ecf says unflavored nic can last years stored in a freezer.:)
